The issue that the punishment for industrial technology outflow is overly generous compared with other similar crimes have been filed. The starting point of the study was fine for the industrial technology outflow which is one of frequently sentenced punishment. According to the conclusions drawn from the analysis of the content of the judgment on industrial technology outflow related cases accumulated until 2016, the gender of the offender and the type of the court had a significant influence on the sentence of fines. Therefore, it is necessary to take a closer look at the factors affecting the assigned court. The characteristics of punishment of industrial technology outflow crime as a whole can be grasped by examining the characteristics of cases that are demanding a formal trial and cases assigned to a single - consensual trial. It was confirmed that the cases of requesting a formal trial in response to an abbreviated order were mainly the cases with a small number of repeated crimes. Also the number of commission was a major variable on the assignment of single judge court even when the court appointed by the request for a formal trial. More specific research results and implications will be discussed in the text.

산업기술유출 범죄 행위에 대한 처벌이 타 유사범죄행위에 비하여 지나치게 관대하다는 의견이 업계와 학계에서 지속적으로 제기되고 있다. 본 연구는 벌금형의 선고나 집행유예의 선고가 지나치게 높다는 지적들이 담긴 연구에 의해 동기부여 되었고, 약식재판에 의해 벌금형을 선고받는 사건의 특징과 정식재판 청구로 이어지는 사건의 특징을 조병해 보는 것을 주요 연구 목적으로 하였다. 2016년까지 선고된 산업기술유출 관련사건 판결문을 수집하였고 총 230건의 판결문에 대한 내용분석을 실시하였다. 결론에 따르면 범죄자의 성별과 재판부의 유형이 벌금형 선고에 유의미한 영향력을 보였다. 더 나아가 정식재판을 청구하는 사건과 단독-합의부 재판에 배정되는 사건이 특징들을 살핌으로서 전반적인 산업기술유출 범죄의 처벌의 양태를 파악할 수 있었다. 약식명령에 불복하여 정식재판을 청구하는 사건들은 주로 범행 횟수가 적은 사건들이었음을 확인하였고 정식재판 청구를 통해 배정된 재판부가 단독 재판부인 경우도 범행 횟수가 주요 변수였음을 알 수 있다. 더욱 구체적인 연구방법과 연구결과들은 본문을 통해 논의하도록 한다.
