This article examines the legal boundaries of nursing practice and unlicensed medical practice, focusing on the Supreme Court Decision 2023Do10286 concerning bone marrow aspiration by an oncology nurse specialist. Relevant precedents were reviewed, considering the invasive nature and risk of the procedure, the degree of physician supervision, and the nurse’s qualifications and proficiency. The Court held that bone marrow aspiration by an oncology nurse specialist is not necessarily an exclusive act of physicians and, under certain conditions, may be recognized as an auxiliary medical act under general supervision. This highlights the need to assess the scope of nursing practice by weighing the risk of the act, patient safety, and the practitioner’s expertise. The paper concludes that this decision serves as a standard for defining the scope of practice and criminal liability of nurses, while underscoring the importance of clear legal criteria and guidelines to safeguard patient safety and ensure a rational division of healthcare roles.

본고는 간호사의 업무범위와 무면허 의료행위의 한계를 둘러싼 법적 쟁점을 검토하 고, 최근 대법원 2023도10286 판결(종양전문간호사 골수검사 사건)의 의의를 분석하 는 데 목적이 있다. 이를 위하여 무면허 의료행위 관련 판례들을 종합적으로 고찰하였다. 특히 골수검사의 침습적 성격, 위험도, 의사의 지도·감독 정도, 간호사의 자격과 숙련도 등을 고려하여 무면허 의료행위 성립 여부가 어떻게 달라질 수 있는지를 분석하였다. 대 법원은 종양전문간호사의 골수검사가 의사만이 독점적으로 수행해야 할 본질적 진료행 위로 한정되지는 않으며, 일정한 요건 하에서는 의사의 일반적 지도 ․ 감독 아래 진료보조 행위로 인정될 수 있음을 확인하였다. 이는 간호사의 직무범위 해석에 있어 행위의 위험 성, 환자 안전, 행위자의 전문성 및 숙련도 등 다양한 요소를 종합적으로 고려해야 함을 보여준다. 따라서 본 논문은 해당 판결이 향후 전문간호사 및 일반간호사의 직무범위 논 의와 형사책임 판단의 기준으로 작용할 수 있음을 밝히며, 법적 명확성 확보와 제도적 가이드라인 정비의 필요성을 제언한다. 이는 환자 안전을 보장하는 동시에 보건의료 인 력 간 합리적 역할 분담을 위한 제도 설계에 기여할 수 있을 것이다.
