(Purpose) The main research objectives of this paper are to analyze and review whether the formation and development of the concept of ‘denizenship’, which guarantees the legal status and rights of permanent foreign residents, contributes to reconceptualizing political rights that realize the principle of national sovereignty, such as the right to vote, as human rights of all people, not as exclusive rights of the people. (Research methods) In relation to the possibility of a new concept of denizen as a new form of concept for guaranteeing the legal status and rights of permanent foreign residents in an immigrant country, we first analyzed and reviewed the discussions on the recognition of voting rights for foreigners in Germany and Korea. (Findings) One of the important complaints raised as one of the factors of persistent political inequality of long-term foreign residents is the demand for guaranteeing full voting rights for the realization of the principle of complete democracy. Relaxing the citizenship acquisition process for long-term foreign residents can have a complementary effect on their demand for equal political rights through recognition of their denizenship. (Conclusion and recommendations) Discussions on expanding the scope of application of the concept of denizenship to better guarantee the legal status and rights of foreign residents or on easing citizenship or nationality requirements and procedures to guarantee their right to political participation contribute to the political integration of foreign residents.

(연구목적) 본 연구의 목적은 정주 외국인 주민들의 법적인 지위와 권리를 보장하는 ‘주민권(denizenship)’개념 의 형성과 전개가 참정권과 같은 국민주권의 원리를 실현하는 정치적 권리를 국민들의 전속적 권리가 아닌, 모든 사람의 인권으로 재개념화하는 데 어떤 기여를 하는지 여부에 대한 검토가 연구목적이다. (연구방법) 본 연구는 이민국가에서 정주 외국인의 법적인 지위와 권리보장을 위한 새로운 형태의 개념으로 주민 권의 새로운 형성가능성과 관련하여 독일과 한국의 외국인 선거권 인정논의에 대한 분석과 검토를 우선적으로 실행하였다. (연구결과) 장기 외국인 거주자의 지속적인 정치적 불평등 요소의 하나로서 제기되는 중요한 불만들 중의 하나는 그들에 대한 완전한 민주주의 원리의 실현을 위한 선거권의 보장의 요구이다. 외국인 이주자의 주민권 인정을 통 한 장기 외국인 이주자의 동동한 정치적 권리보장 요구에 대하여 이들에 대한 국적취득절차의 완화는 보완적 효 과를 가진다. (결론 및 제언) 정주 외국인의 보다 나은 법적 지위와 권리 보장을 주민권 개념의 적용영역의 확대 혹은 그들의 정 치적 참여권의 보장을 위한 시민권 혹은 국적요건과 절차의 완화에 대한 논의는 정주 외국인의 정치적 통합에 기여한다.
