Purpose: The purpose of this study is to analyze the legal nature of the Serious Accidents Punishment Act(SAPA) for workplaces to establish and operate the Safety and Health Management System(SHMS), and reflect it in the construction document of the SHMS. Method: Analyze cases of judgments on serious accidents since the enactment of the SAPA. Investigate the legal nature of the SAPA and the relationship between other laws. Analyze the differences between the SAPA and the SHMS. Through these activities, select the legal requirements of the SAPA necessary for establishment and operation of the SHMS. Result: Even in workplaces that have established SHMS, serious industrial accidents have occurred. The SAPA interprets failure to fulfill obligations given by the law when a serious accident occurs as an act of omission and punishes it, and the violations of the SHMS result in the cancellation or suspension of certification. Conclusion: When establishing and operating the SHMS, the contents of the SAPA must be accurately reflected, and when implementation of this is given top priority, the legal obligations of business owners and managers are met.

연구목적: 본 연구의 목적은 안전보건경영시스템의 구축 및 운영을 위한 사업장을 대상으로 중대재해 처벌법의 법적 성격을 분석하고, 이를 안전보건경영시스템을 구축하는 문서화에 반영하는 방안이다. 연구방법: 중대재해처벌법 시행 이후 중대재해발생에 대한 판결 사례를 분석한다. 중대재해처벌법의 법적 성격 및 다른 법률 간의 관계를 조사한다. 중대재해처벌법과 안전보건경영시스템의 차이점을 분 석한다. 이러한 활동으로 안전보건경영시스템의 구축 및 운영에 필요한 중대재해처벌법의 법적인 충 족 요건을 선별한다. 연구결과: 안전보건경영시스템을 구축한 사업장에서도 중대산업재해가 발생되었 다. 중대재해처벌법은 중대재해가 발생되면 법에서 주어진 의무사항을 이행하지 않을 경우 부작위로 해석하여 처벌하며, 안전보건경영시스템의 위반은 인증의 취소 또는 정지시키는 결과를 받는다. 결론: 안전보건경영시스템을 구축 및 운영할 경우 중대재해처벌법의 내용이 정확하게 반영되어야 하고, 이 에 대한 실행이 최우선으로 실행될 때 사업주와 경영책임자의 법적인 의무가 충족된다.
