The metaverse is a new platform that is created by the interaction between the real world and the virtual world, and it is different from the online spaces or games that we have used in the past. In particular, users can engage in social, economic, and cultural activities that are almost similar to reality through the existence of avatars. Not only is it possible to communicate like in reality, but users can also create their own creations in the metaverse, trade specific items, and build independent characters within the metaverse through avatars. Ultimately, this shows that technological advancement has led to the emergence of another human race in a virtual world that is different from the real world. The emergence of this new human race requires new norms, and we need to think about what role the new norms should play in the new human society. We need to think about what the metaverse is, what stage it has reached, and how it will develop in the future, how avatars should be defined, and whether legal violations should be punished or not, or whether they can be sanctioned through other regulations. Furthermore, through the cause analysis of legal violations in the metaverse, policy suggestions for better metaverse operation and legislative considerations for metaverse operation should also be reviewed. Therefore, this paper studied the role of criminal law and criminal policy in legal violations related to the metaverse, and for this purpose, the following was examined. First, in order to understand metaverse-related crimes, we identified what the metaverse is and the concept and types of metaverse crimes. We also organized the relationship between metaverse crimes and cybercrimes. Then, we examined how the current criminal law and administrative law areas will divide their roles through the types of metaverse-related crimes. Through this, we set the role of criminal law by distinguishing legal violations related to the metaverse into legal violations that will be regulated entirely in the administrative law area and crimes that will be regulated and responded to in the criminal law area within the current legal system. However, in order for the criminal law to ultimately respond systematically and unifiedly to metaverse-related crimes, a new legal system that comprehensively regulates metaverse-related crimes is necessary. Therefore, it is necessary to consider criminal legislation for responding to metaverse regulations and punishments in the future.

메타버스는 현실세계와 가상세계 공간이 서로 작용함으로써 발생한 새로운 플랫폼의 형태로 기존의 우리가 이용한 온라인 공간이나 게임 등과는 다른 점이 존재한다. 특히 사용자가 아바타라는 존재를 통해 현실과 거의 유사한 사회·경제·문화 활동을 할 수 있는데 현실과 같은 의사소통이 가능할 뿐만 아니라 메타버스라는 공간에서 사용자 자신의 창작물을 만들어 낼 수 있고, 특정 아이템을 매매하는 등의 거래도 가 능하며 아바타를 통해 메타버스 내의 독립적인 캐릭터를 구축할 수 있 다. 이는 결국 기술의 발전이 현실세계와 다른 가상세계에서의 또 다 른 인류의 출현을 보여주는 것이다. 이러한 새로운 인류의 출현은 새로운 규범을 요구하게 되고 새로운 규범은 새로운 인류사회에서 어떠한 역할을 해야 할 지에 대해 고민을 할 필요가 있다. 과연 메타버스는 무엇이고 현재 어느 단계까지 왔으 며 앞으로는 어떻게 발전이 될지, 아바타의 정의는 어떻게 해야 할 것 이며 법적 침해행위 발생 시 처벌을 해야 할지 아니면 처벌을 하지 않 아도 될지, 아니면 다른 규율을 통해 제제할 수 있을지에 대한 고민이 필요하다. 더 나아가 메타버스 에서의 법적 침해행위에 대한 원인 분 석을 통해 더 나은 메타버스운영에 관한 정책적 재언 및 메타버스운영 을 위한 입법적 고려요소 또한 검토되어야 할 것이다. 따라서 본 논문에서는 메타버스 관련 법적 침해에 따른 형법 및 형 사정책의 역할에 대해 연구하였는데 이를 위해 다음과 같이 살펴보았 다. 우선 메타버스 관련 범죄를 알아보기 위해 메타버스가 무엇이고 메타버스 범죄의 개념 및 유형이 무엇인지 파악하였다. 또한 메타버스 범죄와 사이버범죄가 어떠한 관계에 있는지에 대해서도 정리하였다. 그리고 메타버스 관련 범죄의 유형을 통해 지금의 형법 영역과 행정법 영역이 어떻게 역할을 나눌 것인지에 대해 살펴보았다. 이를 통해 메타버스 관련 법적 침해가 현행 법 체계 내에서 전적으로 행정법 영역 에서 규율할 법적 침해와 형법 영역에 규율하여 대응할 범죄 등을 구 분하여 형법의 역할을 설정해 보았다. 하지만 최종적으로 형법이 메타 버스 관련 범죄에 체계적이고 통일적으로 대응하기 위해서는 메타버스 관련 범죄에 대해 통합적으로 규율하는 새로운 법체계가 필요할 것으 로 본다. 그래서 향후 메타버스 규제 및 처벌 등 대응을 위한 형사입 법도 고려해 볼 필요가 있다.
