Our aging population is growing faster than any other country in the world. The rapid transition from a low birth rate to a super-aged society is throwing various unexpected problems and tasks to our society. Crime is no exception to the rapid demographic change. The increase in the elderly population means, of course, that the number of crime victims of the elderly population will increase. In particular, in the case of the majority of the elderly, who are vulnerable to the non-face-to-face society and advanced technology resulting from rapid informatization, they are exposed virtually defenselessly to various frauds and predatory crimes. At the same time, the number of crimes committed by the elderly against the elderly is also increasing along with the increase in the elderly. How to protect the elderly who are relatively vulnerable from these various crimes and how to prevent them from crimes is an urgent task that we should pay attention to. Changes in demographic structure and family relationships, reduction and closure of face-to-face contacts, lack of openness to information due to confirmation bias, and absence of a legal concept for predatory are the causes and problems of elder predatory crimes. In order to properly respond to this, first of all, it is necessary to prepare a plan to select and support elderly persons subject to protection, and to establish a public institution for entrusted management of property. In addition, the investigative agency's investigation method for crimes against the elderly should be improved, and the legal concept of looting crimes should be established and punishment provisions should be prepared.

우리는 세계의 어떤 다른 국가보다 빠른 속도로 고령인구가 증가하고 있다. 저출생에서 비 롯된 급속한 초고령사회로의 전환은 예상하지 못한 각종 문제와 과제를 우리 사회에 던져주 고 있다. 급격한 인구구조의 변화에 범죄도 예외일 수 없다. 고령인구가 증가한다는 것은 너 무나도 당연히 고령인구의 범죄피해 건수가 증가할 것이라는 것을 말해준다. 특히 급속한 정 보화에 따른 비대면사회와 첨단기술에 취약한 대다수 노인들의 경우 각종 사기와 약탈성 범 죄에 사실상 무방비로 노출되어 있다고 볼 수 있다. 동시에 노인이 노인을 상대로 각종 범죄 를 저지르는 건수도 고령층의 증가와 함께 동시에 늘어나고 있다. 이러한 각종 범죄로부터 상대적으로 취약한 노인들을 어떻게 보호하고 범죄로부터 예방할 것인가는 이제 우리가 관심 을 가지고 살펴봐야하는 당면한 과제이다. 인구구조와 가족관계의 변화, 대면접촉 대상자의 축소와 폐쇄성, 확증편향에 따른 정보에 대한 개방성 부족, 약탈에 대한 법적 개념의 부재는 노인약탈범죄의 원인이자 문제점이다. 이를 적절히 대응하기 위해서는 우선 보호대상 노인에 대한 선별 및 지원방안을 마련하고 재산위탁관리 등을 위한 공공기관 설립해야 한다. 그리고 노인을 대상으로 한 범죄에 대한 수사기관의 수사방식 개선하고 약탈범죄에 대한 법적인 개 념 확립과 처벌조항 마련해야 한다.
