The aim of this study is to arrange and situate J. Finnis’s focal conception of the practical reasonableness, to trace the assumptions in his [Natural Law & Natural Rights], and thereby to propose(or gain) some useful perspective of the meaning of the practical reasonableness principle. John Finnis's Natural Law and Natural Rights(1980, 2011) is one of the representive books on the classic natural law theory. In this paper I would like to articulate the theoretical background and motive, the whole constitution and overall scheme of Finnis's argumentation in this book. Also this paper attempts to arrange and situate Finnis's critical evaluation of descriptive methodology and conception of analytical or sociological jurisprudence, and to propose some guide to identify Finnis's significant concepts, 'the Good(s) and its requirements of practical reasonableness'. Finnis argues that the basic goods and the basic methodological requirements are to constitute the universal and self-evident principles of natural law. Although in this essay could not implied all the expounded identifications of every ideas of this book, but the least this paper would propose some instructions to read Finnis's book ‘Natural Law & Natural Rights’ and to understand with a holistic view Finnis's conception of law on the requirements of practical reasonableness.

매우 난해하게 저술된 피니스(J. Finnis)의 대표저작인 ｢자연법과 자연권Natural Law & Natural Rights｣를 독해함에 있어서 가장 핵심적인 개념은 무엇일까? 자연 법, 자연권, 인간의 행복, 공동선, 인간 기본선, 이성, 실천이성 등등. 한편으로 그 어떤 전체적인 통일된 집합체의 구성 부분인듯하기도 하고, 다른 한편으로 서로 상 이한 영역과 지위를 갖는, 이러한 여러 관념들을 관통하는 개념은 ‘실천적 합당성 practical reasonableness’라고 할 수 있을 것이다. 이 글에서는 ｢자연법과 자연권｣의 핵심 개념인 실천적 합당성에 집중하여 피니스의 자연법 이론을 파악하고자 한다. 특히 실천적 합당성의 기본 요건들을 살펴보면서, 피니스의 자연법론에서 제시되 는 가정과 주장, 명제와 논증, 평가와 가치 등등을 ‘실천적 합당성’이라는 기본 축 으로 가능한 한 분명하게 파악해본다. 실천적 합당성에 대한 정확한 이해는 피니스 의 자연법론의 기초적 질문, 즉 올바른 실전적 추론과 적절한 질서가 무엇인가라는 질문을 해결해나가는 길을 열어줄 것이다.
