As the debate on platform labor has progressed, it has moved beyond the stage of debating whether platform workers should be recognized as workers or not, and we are now considering how to effectively apply labor protection laws that have been operated in the framework of dependent workers to platform workers. In Korea, there has been discussion on the enactment of special law of protection for platform workers, and this paper focuses on normative or legislative attempts to protect the working conditions of platform workers and reviews overseas cases. The cases included in this paper are: ① “Fair and equal social protection for riders, drivers and other platform workers” legislative directive (2021) of EU, ② “Guidelines on the application of Union competition law to collective agreements regarding the working conditions of solo self-employed persons” (2022/C 374/02) of EU, ③ Japanese “Guidelines for establishing a safe working environment as a freelancer” (フリーランスとして安全して働ける環 境を整備するためのガイドライン) (March 26, 2021), ④ Ley Riders of Spain ⑤ APEC: Guidelines on Providing Social Protection to Digital Platform Workers, and finally, ⑥ Ontario's Bill 88(the Working for Workers Act, 2022). This paper summarizes the main contents of each case, and includes a translation of the full text of each case for the purpose of the case study.

플랫폼노동에 대한 논의가 어느 정도 궤도에 오르면서, 플랫폼노동자 의 근로자성 인정 여부에 대한 지난한 논쟁의 단계를 넘어, 이제는 어떻 게 종속적 노동자의 틀에 맞추어져 운용되어 오던 노동보호법제를 플랫 폼노동자에게 실효성 있게 적용할 것인지의 방법을 고민하는 모습들이 보인다. 우리나라에서도 플랫폼노동자들에 대한 특별법적 형태의 보호 법 제정에 관한 논의가 있었는데, 본고는 플랫폼노동자의 근로조건 보호 를 위한 (준)규범적 시도에 초점을 맞추고 해외 사례를 검토해보고자 하 였다. 본고에 포함된 사례는 ① EU ｢라이더, 운전기사 등 플랫폼노동을 위한 공정하고 평등한 사회적 권리 보장(Fair and equal social protection for riders, drivers and other platform workers)｣ 입법지침(2021), ② EU ｢1인 자영업자의 노동조건에 관한 단체협약에 대한 경쟁법 적용 지침｣ (Guidelines on the application of Union competition law to collective agreements regarding the working conditions of solo self-employed persons)(2022/C 374/02), ③ 일본 􋺷프리랜서로서 안심하고 일하는 환경 을 정비하기 위한 가이드라인􋺸(フリーランスとして安心して働ける環境 を 整備するためのガイドライン)(2021. 3. 26.), ④ 스페인 라이더법(Ley Riders), ⑤ APEC : 디지털 플랫폼노동자에 대한 사회적 보호의 제공을 위한 지침 (Guidelines on Providing Social Protection to Digital Platform Workers), 그리고 마지막으로 ⑥ 캐나다 온타리오주 디지털 플랫폼노동 자 권리법(Bill 88, the Working for Workers Act, 2022)이다. 본고는 각 사례의 주요 내용을 정리하면서, 사례연구의 목적상 각 사례의 내용이 좀 더 분명하게 전달될 수 있도록 각각의 전문을 번역하여 포함시켰다.
