This study is aimed to observe the process of translating ‘obligations’ into Japanese, which are the basic concept of the modern rule of law in western ideology. In the early 1860s (which were the early days of modern Japanese translation), there were various types of translations such as [務][職分][關係]. In the mid1860s, the narrative translation form was often used, such as [務むへき義] [務めさることの義] [義を務む]. Among these descriptive translation forms, [義務] was created and used, which abbreviates [義を務む] which is similar to the Japanese narrative form. After 1870, enlightenment scholars at Kaiseizo (開成所) and Meirokusya (明六社) used [義務] in more than narrative translation forms in their works, thereby spreading it to the general public. In Korean data, “義務” was first discovered by “Hanseong Jubo” (1886). In the 1890s, examples used in modern Western enlightenment books such as “Seoyu Gyeonmun” (1895), popular newspapers like the “Hwangseong Newspaper” (1898), and the “Independent Newspaper” (1899) were found. Through this, it is judged that [義務] in Joseon in the late 1890s was generalized to the extent that it would not be unreasonable to use it with the general public.

1860년대 초반, 근대 일본에서 [obligation]은 [務][職分][關係]등으로 번역되었다. 1860년대 중반에는, [務むへき義] [務めさることの義] [義を務む]와 같은 서술적 번역 형태로 번역되었고, 동시에 [義を務む]를 축약한 [義務]로 번역되기도 하였다. 1870년 이후, 開成所, 明六社의 계몽 학자들이 서술적 번역 형태보다는 2자 번역어인 [의무]를 다수 사용하면서 대중화되었다. 한국 자료에서 [의무]가 처음 발견되는 것은 “한성주보”(1886)이며, 1890년대에는 『서유견문』(1895), “황성신문”(1898), “독립신문”(1899)에서 사용한 예가 발견된다. 특히 대중을 상대 로한 신문에 [의무]가 다수 사용되고 있다는 점에서, 이미 1890년대 후반 조선에서 [의무]는 대중적 사용이 가능했던 단어였던 것으로 추정한다. 약육강식의 시대, 국가적 생존을 위해 서구 신문명의 이해에 몰두한 한중일 삼국의 번역가 들에게, 번역이라는 것은 단지, 외국어를 자국어로 바꾸는 단순한 행위가 아니라, 스스로 정 체성을 자각하고 자국의 근대화를 성공시켜 자국의 존립을 담보하기 위한 애국의 방식이었 다. 이러한 근대 개화론자들의 서양어 번역에 대한 태도는 자국의 근대화를 보다 자국에게 적합하게 만드는 토대를 마련하려는 지난한 노력이었다는 점에서 그 가치를 높이 평가해야 할 것이다.
