The expeditious growth of Metaverse industry has enabled diverse human activities to be carried out in a virtual world rather than a real world. While Metaverse may increase the affordability of a broad range of experiences previously available only to a specific group of people, it is not without any side effects. In the current Metaverse platform as it is, certain human values are harmed by the verbal or visual acts of the avatars vicariously acting for the natural persons controlling the avatars. In the future Metaverse platform combined with the other technologies―XR, Tracking, Haptic technologies―, more diverse and crucial human values are expected to be harmed. Accordingly, to attain sustainable development of Metaverse industry, it is essential to secure the safety of Metaverse by effectively preventing the various possible harms. As a part of such efforts, this paper illustrates the ethical duties of each subject involved with Metaverse so as not to contribute directly or indirectly to the harm; suggests the core ethical duties to be adopted as a legal duty through administrative regulations; explains the limitations to be considered in enacting such administrative regulations in view of the special characteristics of Metaverse. After all, this paper wishes to assist Korea as a leader of Metaverse industry to take initiative in setting the global norms required to secure the safety in Metaverse.

메타버스 내 아바타를 통한 가상활동의 증가와 확대는 우리 정부가 뉴딜 2.0을 통해 기대하는 바와 같이 보다 편리하고 다채로운 일상생활의 영위라는 순기능만 가져다줄 것으로 보이지 않는 다. 이미 현재 메타버스 내에서는 아바타를 통해 표출되는 언어적, 시각적 행위에 의한 일부 법익에 대한 침해가 야기되고 있다. 나아가, XR, Tracking, Haptic 등 다양한 기술들과 결합한 미래 메타버스에서는 아바타를 통해 표출되는 물리적 행위에 의해 보다 다양하고 중대한 법익에 대한 침해 야기까지도 예견된다. 따라서 메타버스의 지속가능한 발전을 위해서는, 아바타를 통해 야기될 수 있는 다양한 침해 를 사전 방지하기 위한 노력들이 병행되어야 한다. 이를 통해, 편리할 뿐만 아니라, 안전한 메타 버스 사회가 구현될 수 있도록 하여야 한다. 이에 본 연구에서는 메타버스 내 침해 사전 방지를 위해 메타버스 관련 각 주체별―i) ‘침해를 직접 야기하는 주체’로서 아바타 조종자인 자연인, ii) ‘침해 야기자를 통제하는 주체’로서 아바타 조종자의 사용자인 법인 또는 자연인, 그리고 iii) ‘침해 야기 환경을 통제하는 주체’로서 아바타 조종자가 활동하는 메타버스의 서비스 제공자―요구되는 윤리적 의무들을 제시하였다. 나아가, 이 중 어떠한 윤리적 의무들이 행정규제의 대상으로서 법적 의무로 강제되어야 하는지에 대한 방향을 제시하고, 관련 행정규제 입안 시 메타버스 특성을 반영하여 고려하여야 할 한계들을 설명하였다. 본 연구를 통해, 보다 안전한 메타버스 사회를 구현할 수 있도록 함으로써, 대한민 국이 지속가능한 메타버스 산업의 선두주자로서 법제도적 기준을 제시하는 국가가 될 수 있도록 하는데 기여하고자 한다.
