Recently, some U.S. states and Canada have licensed marijuana for leisure, and this trend is rapidly increasing. Compared to the severity of hallucinations, hemp has fewer cases of addiction, and if used properly, it seems that there is no problem in using it for leisure. In addition, as cannabidiol (CBD), a marijuana component, has been proven effective in treatment in patients with epilepsy, it is requesting continued permission for the use of medical hemp intentionally removed from tetrahydrocannabinol, which has led to changes in policy on some uses. However, hemp is severely punished under the current criminal law and hemp management law, and legal measures are urgently needed as the fraudulent use of many hemp due to poor management of medical hemp can be a problem. In response, this paper aims to assess trends in some countries that have recently decriminalized marijuana use, assess the safety of medical marijuana use, and review the import and management system of domestic marijuana components to contribute to the establishment of policies to prevent misuse of medical marijuana components.

최근 미국의 일부 주정부와 캐나다는 대마의 레져용 사용을 허가하고 있으며 이러한 레져 용 대마사용 허가 추세가 급속히 증가하고 있다. 대마는 환각 증세의 엄중성에 비하여 중독의 사례가 적고, 적절히 사용할 경우 레져용으로 사용하는데 문제가 없다고 판단한 것으로 보인 다. 또한 뇌전증 환자에게 대마의 성분인 칸나비디올(CBD)이 치료의 효과가 입증됨에 따라 테트라히드로칸나비놀 성분을 의도적으로 제거한 의료용 대마의 사용에 대하여 지속적인 허 가를 요청하고 있고, 이에 법령정비를 통해 일부 사용에 대한 정책의 변화가 일어나고 있는 실정이다. 그러나 대마의 경우 현행 형법 및 대마관리법에 따라 엄벌하고 있으며, 의료용 대 마의 관리소홀로 인한 다수의 대마의 부정사용이 문제가 될 수 있어 이에 대한 법적 대책마련 이 시급하다. 이에 본 논문은 최근 대마사용의 비범죄화 추세에 있는 일부 국가에 대한 추세 를 평가하고 특히 의료용 대마사용의 안전성을 평가하며, 국내 의료용 대마성분의 수입 및 관 리체계를 검토하여 의료용 대마성분의 오남용을 방지하는 정책의 수립에 기여하고자 한다.
