It is undeniable that the European Union's public procurement guidelines, as amended in 2014, may produce some differences in the realization of its contents in the course of domestic legal transformation among its members. However, there is no denying the possibility of some homogenization or generalization due to the binding nature of the purpose of the guidance as the primary court of the European Union. Therefore, Germany's public procurement legislation should be grasped from the macroscopic perspective of the European Union's public procurement legislation. 2014년에 개정된 유럽연합의 공공조달 지침은 비록 회원국 간에 국내법적 변환 과정에 서 그 내용의 실현에 있어서 다소 차이가 발생할 수 있다는 점은 부인할 수 없는 사실이 다. 그러나 유럽연합의 제1차적 법원으로서 지침이 가지는 목적 구속성 성격으로 인해 어느 정도 균질화 내지는 일반화가 이루어질 수 있는 가능성도 부인할 수 없다. 따라서 독일의 공공조달법제는 유럽연합의 공공조달법제라는 거시적인 관점에서 파악을 해야 한다. 이러한 관점에서 새로운 경제적 환경에 대응하기 위한 유럽연합차원에서의 공공조 달법제의 개편방향이 독일 공공조달법제의 최근 개정내용에 반영된 것으로 볼 수 있다. 다만 경쟁법 제127조의 “경제적으로 가장 유리한 입찰”이 최소비용을 의미하는 것이 아 니라 “최선의 가격-성과 비율에 의한 입찰”을 의미하는 것으로 보면서도 낙찰의 기준에 있어서는 전체 경제적 의미에 기초한 예산법적 의미보다 객관적 성격을 가지는 경제적 합리성에 기반 한다는 점은 특이하며 이를 결국 감사에 있어서 어느 지점을 어떻게 평가 할 것인가의 문제와 결부된다.
