The purpose of this study is to improve of the legal system for infringement remedy of teacher's right in school, which is one of the causes behind collapsing schools, and clarifying the coverage of teachers’ rights. This study analyzes the meanings of ‘Teachers' educational authority’ as teachers' authority, as teachers' right to education, as well as total rights for teachers. Different perspectives on teachers’ rights exist among lay people, scholars, which may generate confusion and differences in understanding teachers’ right. It compares and analyzes how related acts of law define and interpret teachers’ rights. As such, the needs of authority concerns guaranteeing the right to education for teachers with professional positions. And this position suggests that the current legal institutions make efforts and focus on securing teachers' positions, as well as strengthening their socio-economic status.

이 연구는 교원의 교육권 보호 및 스승존중 풍토 조성을 위한 교권확립 실천방안을 제안하는 데 목적이 있다. 학교는 교원과 학생이 고도로 밀착된 인간관계를 바탕으로 지식의 이해와 감정을 공 유하는 ‘인간(적인) 공동체’를 전제로 만들어진 곳이다. 하지만 교권 침해의 사례는 양적 증가와 함 께 날로 심각해지고 있다. 즉, 사교육 팽배, 교원의 학생체벌 금지, 학생인권 조례, 학교폭력 및 교 원폭력 증가 등으로 인해 교원의 전문적 교육활동을 저해하거나 침해하는 일들이 갈수록 증가하고 있다. 학교현장에서 빈번히 제기되고 있는 학부모의 부당한 폭행·협박 및 민원제기 등은 심각한 수준에 있으며, 이는 곧 교원의 인권 침해 및 교원의 정당한 교육 지도권에 반하는 행위로 사료된 다. 이러한 문제인식에 기초한 국·내외 교권 침해의 사례와 관련 문헌을 고찰하여 교원의 교육권 보호를 위한 체계적인 법·제도적 개선방안을 제안하였다. 향후 교육적 생태 환경의 변화 속에서 변 화지향성과 공동주의의 가치를 담아낼 수 있는 조화와 균형, 포괄, 연계를 반영한 홀리스틱 교육 의 가치와 의미를 제고할 필요가 있다.
