Today, the importance of protecting industrial technologies is increasing as the 4th Industrial Revolution converges and integrates each industry and expands advanced industrial technologies. With the launch of the government, the Small and Medium Business Administration has been promoted to the Ministry of Small and Medium Enterprises, and various policies and systems are being implemented to protect the technology of SMEs. This study first considers domestic and foreign literatures such as current laws and systems related to SME technology protection and previous studies. At the same time, the government looked for ways to improve SME technology protection through interviews with experts from various governments, law enforcement agencies, media, and SME CEOs. Based on the experience and know-how of SMEs' technology protection experts, the government tried to draw up ways to improve laws and systems related to technology protection that can be effectively executed. In order to unify SME technology protection, it is necessary to amend the SME Technology Protection Act and establish a tentative SME Technology Protection Committee(Chairman: Minister of SMEs and Venture Companies), a control tower organization that can oversee policies. SMEs and venture companies should implement strict criminal punishment systems such as the Korean Intellectual Property Office and the Fair Trade Commission, introducing special police jurisdiction over technology infringement of SMEs. Throughout our society, the perception that“technological exploitation is a crime”should also spread. In the future, efforts should be made to find effective and practical policies and systems that can be felt in the SME field.

오늘날 4차 산업혁명으로 각 산업이 융·복합화 되고, 첨단 산업기술도 확대됨에 따라 산업기술 보호의 중요성이 더욱 증가하고 있다. 현 정부는 출범과 더불어 중소기업청을 중소·벤처기업부로 승격시키며 중소기업 기술보호를 위한 각종 정책 및 제도를 시행하고 있지만 기술유출 및 기술탈취는 여전히 계속되고 있다. 본 연구는 우선적으로 중소기업 기술보호와 관련된 현행 법·제도 및 선행연구 등의 국내·외 문헌을 고찰하였다. 이와 함께 중소기업 기술보호 관련 정부·수사기관 및 전문기관, 학계, 법조계, 언론사, 중소기 업 CEO 등 각계 전문가 인터뷰를 통한 질적 연구방법으로 중소기업 기술보호 개선방안을 모색하였다. 중소기업 기술보호 전문가의 경험과 노하우를 바탕으로 중소기업 현장에서 실효성 있게 집행될 수 있는 기술보호 관련 법·제도 개선방안을 도출하여 정부의 정책안 으로 제시하고자 하였고, 연구결과는 다음과 같다. 중소기업 기술보호 관련 일원화를 위해 중소기업 기술보호법 개정이 필요하며, 정책을 총괄할 수 있는 컨트롤타워 기구인 가칭 중소기업기술보호위원회(위원장:중소·벤처기업 부장관)를 설립하여야 한다. 중소·벤처기업부가 특허청, 공정거래위원회처럼 중소기업의 기술침해에 대한 특별경찰사법권을 도입하는 등 엄격한 형사처벌 제도를 실시해야 한다. 우리 사회 전반에 걸쳐서‘기술탈취는 곧 범죄다’라는 인식도 확산되어야 한다. 또한, 앞 으로 중소기업 기술보호 문제와 관련하여 중소기업 현장에서 체감할 수 있는 효율적이고 실질적인 정책과 제도를 찾아내는 데 노력해야 할 것이다.
