This paper deals with the violation of medical law related to the use of medical device by a Korean medical doctors. These problems have been treated as unlicensed medical activities related to licensing scope of korean medical practitioners, and as the development of modern medical devices has become more and more intensified with the conflict between doctor and korean medicine. The Court has strictly judged these issues and has allowed exceptional cases in individual cases. The following is to review the concept of medical practice, the trends and judging criteria of precedents in the licensing scope of physicians and oriental medical practitioners, the evaluation of case precedents for epilepsy use cases, I would like to draw conclusions about the strengthening of standards.

본 논문에서 한의사의 의료기기 사용과 관련하여 의료법위반문제를 다루고 있다. 이러한 문제는 한의사의 면허범위와 관련하여 무면허의료행위로 다루어져 왔고, 현대의료기기의 발전에 따라 더욱 의사와 한의사의 갈등문제로 격화되어 왔다. 이러한 문제에 대해 법원은 엄격하게 판단하여 왔고 예외적으로 개별적인 사례에서 허용하여 왔다. 다음에서는 의료행위의 개념과 의사와 한의사의 면허범위에 대한 판례의 동향과 판단기준을 살펴보고 한의사의 뇌파기 사용사건에 대한 판례의 평가와 함께 구체적인 판단기준에 대한 검토와 의료기기 사용에 따른 책임기준의 강화에 대한 결론을 도출하고자 한다.
