The Korean Medical Act governs the requirement of the establishment of the Medical Institution. Above all, one can not establish a medical legal entity out of greed. Only the doctors are allowed to open the practice and a doctor can only set up and operate a medical institution. If man violates these rules, this medical institution becomes an illegal one. The illegal medical institutions cause many social problems that are the health threat against the people, annihilation of the medical order, financing threat against the health insurance etc. The aim of eliminating the illegal medical institution is to discover it at an early stage. For this, an altanative to authorize the National Health Insurance Service (NHIS) to special police is proposed. This is about whether no authority and officials can be authorized to special police.

2018. 12. 6. 국회에 ‘사법경찰관리의 직무를 수행할 자와 그 직무범위에 관한 법률 일부개정법률안’이 발의되었다. 그 주요골자는 의료인 또는 약사의 명의나 자격증을 대여하거나 모용하여 자격 없는 자가 의료기관 및 약국을 개설․운영하는 이른바 ‘사무장병원․약국’의 효율적인 단속을 위해 국민건강보험공단 임직원에게 특별사법경찰권을 부여하는 것이다. 불법개설기관은 개설당시부터 영리추구만을 목적으로 하고 있다. 불법적인 의료광고, 의료기기의 재사용, 무리한 환자 유치 등 수 많은 문제들이 지금까지 나타났고 또 나타나고 있다. 이는 의료서비스의 질을 떨어뜨리고 의료시장질서를 파괴한다. 또 불법개설기관의 부당청구는 건강보험재정누수의 가장 많은 부분을 차지하고 있는 것 역시 간과할 수 없는 부분이다. 불법개설기관의 행위는 가장 직접적으로는 치료를 받는 환자가 적절한 치료를 제공하지 않는 것은 물론 국민의 납부로 형성된 건강보험의 재정안정성을 위협하고 있기 때문이다. 이러한 불법개설기관의 효율적 단속은 신속하고 전문적인 수사가 전제될 때 가능하다. 하지만 불법개설의료기관의 문제를 일반사법경찰이 담당하고 있는 현행 사법제도 하에서는 이를 기대하기 쉽지 않다. 이에 본 논문에서는 이러한 문제의 해결을 위한 하나의 방법으로 국민건강보험공단 임직원에게 특별사법경찰권을 부여하는 방안을 검토해 보았다.

Das koreanische Medizingesetz regelt die Voraussetzung der Einrichtung der Medizinischen Institution. Vor allem darf man aus Gewinnsucht keine medizinische Rechtsperson einrichten. Nur die Ärzte dürfen die Praxis eröffnen und ein Arzt kann nur eine medizinische Institution einrichten und betreiben. Wenn man gegen diese Regelungen verstoßt, wird diese medizinische Institution zu einer illegalen. Die illegalen medizinischen Institutionen verursachen viele sozialen Problemen, die Gesundheitsbedrohung gegen das Volk, Vernichtung der medizinischen Ordnung, Finazierungsbedrohung gegen die Krankenkasse usw. sind. Es geht für die Beseitigung der illegalen medizinischen Institution darum, dass sie in dem frühen Stadium entdeckt werden. Dafür ist eine Altanativ, the National Health Insurance Service(NHIS) zur Sonderpolizei zu autorisieren, vorgeschlagen. Hier geht es darum, ob keine Behörde und Beamter zu Sonderpolizei bevollmächtigt werden können.
