Globalization and digitalization, which took place in the 1980s and thereafter, not only did multinational companies manage the world, but also developed qualitatively different aspects of the international financial market. In the midst of the whirlpool of the Asian economic crisis in 1997, Korea was restructured through all of its projects, including financial sector and manufacturing, through the bailout at the end of 1997. Since then, the employment environment has changed greatly due to continuous changes in the economic environment, including the 2008 global financial crisis and the 2011 European economic crisis. The labor market's rigidity in recent years has hampered job creation and caused job losses for young people. The topic of this review was the stability of employment and the limitation of layoff. First, we looked at stable employment and labor regulations(II). We also looked at the right laws for termination of employment, management layoffs and termination laws(III). We looked at future layoff policies (relaxation of termination restrictions related to layoff policy, monetary compensation system for user layoffs, restrictions and social consensus on layoffs, guaranteeing the livelihood of the unemployed, reemployment, inhibition of labor unions and the role of labor law)(IV).

1980년대 이후 세계화와 디지탈화는 세계경영은 다양한 양상으로 펼쳐졌다. 1997 년말 IMF 경제위기시 금융권, 제조업 등 모든 사업에서 구조조정이 시행되었다. 2008년 글로벌 금융위기, 2011년 유럽경제위기 등 지속적인 세계경제 환경의 변화 에 따라 고용노동환경이 크게 변화되었다. 어쩌면 경제위기 상황에서 고용조정을 쉽 게 함으로써 기업의 도산을 막고 경영의 어려움을 덜어주어 대량실업을 예방하며, 향후 경기가 좋아지면 더욱 고용을 늘릴 수 있다. 하지만, 최근에 한국의 노동시장 의 경직성은 일자리 창출을 저해하고 청년 등의 고용절벽을 야기하는 원인이 되고 있다. 본고에서는 이러한 문제 의식에 기초해 ‘고용보장과 해고의 제한’이라는 주제로 서, 먼저 안정된 고용과 노동법적 규제를 살펴보았다(Ⅱ). 또한, 해고의 제한에 대한 정당한 해고법리 및 경영상해고와 해고제한법리를 살펴보았다(Ⅲ). 그리고 해고정책 의 개선(해고정책과 관련된 해고제한의 완화, 사용자에 의한 해고의 금전보상제도, 해고의 제한과 사회적 합의, 실업자의 생활보장과 재취업, 노동조합의 억제력과 노 동법의 역할)에 대하여 살펴보았다(Ⅳ).
