There have been adverse criticisms on the political neutrality of the exercise of investigation and indictment power by the Prosecutions Office against the high-ranking officials in Korea. Due to this, the distrust against the Prosecutions Office among Korean people has been expanded. Now, according to a public survey, about 82% of Korean people wants to have the High-Ranking Officials Corruption Investigation Agency separate from the Prosecutions Office. This paper aims at exploring the desirable contents of the High-Ranking Officials Corruption Investigation Agency Act by the legislative review of the concerned bills which are submitted in Congress now. To achieve the aim, this paper examines the legislative background and progress of the High-Ranking Officials Corruption Investigation Agency Bills from the 15th Congress to the current 20th Congress at first. Then, it analyzes and compares the four major bills on the High-Ranking Officials Corruption Investigation Agency. Finally, this paper will evaluate the bills and explore their desirable reform directions.

우리나라에서는 오래 전부터 고위 공직자의 직무 관련 부정부패사건에 대한 검찰의 수사와 기소권 행사를 두고 정치적 중립성 시비가 끊이지 않았고, 전･현직 검사에 대한 수사와 기소에 있어 ‘제식구 감싸기’식 봐주기 수사도 이어졌다. 이로인해 검찰권력에 대한 국민들의 불신은 커졌고 이제 절대 다수의 국민들이 고위공직자비리수사처 설치를 요구하고 있다. 더욱이 지난 대선에서 더불어민주당, 국민의당, 정의당과 바른정당의 후보들도 공수처 설치를 대선공약으로 내걸었다는 점을 상기할 필요가 있다. 본 연구는 지금 국회에 제출되어 있는 주요 공수처 법안들에 대한 입법평가를통해 바람직한 공수처 법안은 어떤 것이어야 하는가를 규명하는 것을 연구의 목적으로 한다. 이를 위해서 우선 공수처법 제정의 필요성이 제기된 입법적 배경과 그 동안 제15대 국회부터 현 20대 국회에 걸치는 공수처법안들의 입법 경과를 살펴본다. 그리고 박범계-이용주 의원안, 참여연대 입법청원안, 법무･검찰개혁위원회 권고안, 법무부의 자체 법안들을 주요 내용들을 분석하고 비교한다. 끝으로 이 공수처 법안들에 대한 전반적인 평가와 함께 공수처 법안들의 개선 방향을 모색해 본다.
