The purpose of this article is to discuss the change of the political-legal environment in the current democratic Constitutional State and the understanding and react of the social studies education. The phenomenon of the Judicialization of Politics was suggested as an example of political-legal environmental change, regarded as an integration of politics and law in educational aspect. The related arguments were as follow. ① Changes in educational conditions before and after the constitutional amendment in 1987 were discussed. ② Social studies curriculum and the educational contents about constitution in textbooks were analyzed. Through these analyses, considerations about ‘what’ and ‘how’ to teach in social studies education were discussed. The Constitutional education was emphasized as a rights education and life norm education in ‘what’ to teach part, and discussions on cases study by understanding the cases as a process rather than a result were regarded important in ‘how’ to teach part. In conclusion, citizenship was emphasized as a link for harmony between reality and norms.

본 논문은 현대 민주적 법치국가에서 정치-법적 환경 변화에 따른 사회과 교육의 이해와 대응에 관 한 논의를 목적으로 하였다. 사례로 정치의 사법화 현상을 제시하였으며, 이를 교육적 측면에서 정치와 법의 통합 현상으로 이해하였다. 구체적 논의로, 첫째, 1987년 헌법 체제 이전과 이후의 교육과 관련된 변화 양상 을 살펴보았으며, 둘째, 사회과 교과서의 헌법 관련 판례자료를 분석하였다. 이를 통해 정치와 법의 통합적 이해의 필요성을 강조하였으며, 사회과 교육의 대응으로 ‘무엇을’, ‘어떻게’ 가르칠 것인가를 논의하였다. 구 체적으로 권리교육과 생활규범으로서 헌법교육을 강조하였으며, 판례를 결과가 아닌 과정으로 이해하여 논 쟁적 주제로서의 판례학습을 강조하였다. 이상의 논의를 통한 최종적 결론으로 정치와 법이라는 현실과 규 범의 조화를 위한 연결고리로써 선한 질서를 위한 시민의식을 강조하였다.
