In order to inspect what the educational institutions should prepare for lowered voting age, the paper presented constitutional and educational theoretic perspectives along with relative situations, problems and solutions. From the perspective and constitutional theory, the study presented how teachers should deal with political issues and how much students have the freedom of political expression. First of all, if it is educationally necessary to deal with political and social issues, teachers should not avoid them and manage them. In dealing with political issues, teachers should note to present multiple different views on them in a balanced manner. Not any state or political forces should intervene in such an educational process nor should any educational forces intervene in politics illicitly. Second, if we consider the guarantee of students’ freedom of political expression and its limitations, students can also have the freedom of speech, in principle. State can limit the freedom of speech only when the constitutional requirements to limit the basic rights should be met. Also, to improve the power of school rules, school roles need to be further specified according to the set procedures of schools. If school rule specification is difficult, an upper-level educational institution should be able to present a standard set of school roles to be reflected in the corresponding schools. From the educational theoretic perspective, the study presented election-related educational situation, problems and solutions. First, in the high-school society curriculum, Society and Law and Politics are the subjects related to election education. They Should be expanded beyond election education into political participatory programs. Second, discussion-oriented classes should be expanded to cover diverse themes such as political substances, social policy elements and school policy elements. Third, educational program on democratic citizen will have to be reinforced in all of the school curriculum subjects in addition to Society. Forth, the expression Article 2 of the Framework Act on Education should be refined to more clearly define the purpose of Korean education, democracy education. Chapter 3 of the Framework Act on Education need to have a new clause obliging state and local government to establish the necessary policies for democracy education. Fifth, ways for active student participation at school should be explored such as broader student participation, students’ own budget management, establishment of students’ self-governing space, meeting with the school head, and network with other local students’ councils.

본 논문은 선거권 연령 하향에 대비하여 교육기관에서 무엇을 준비하여야 하는지 점검하기 위하여 헌법이론적 관점과 교육이론적 관점에서 쟁점을 제시하고 그에 대한 현황, 문제점, 개선방안을 제시하였다. 헌법이론적 관점에서는 교사가 정치적 쟁점을 어떻게 다루어야 하는지, 학생은 어느 정도의 정치적 표현의 자유가 있는지 제시하였다. 첫째, 학생의 교육을 담당하는 교사는 교육상에 필요에 의하여 정치적‧사회적 쟁점을 다루어야 할 경우 이를 회피하지 말고 다루어야 한다. 다만 정치적 쟁점을 다루면서 이에 대한 여러 견해를 균형 있게 제시하여야 한다. 한편, 국가나 정치세력은 교육에 부당하게 간섭하여서는 안 되며, 교육도 정치에 부당하게 영향력을 행사해서는 안 된다. 둘째, 학생의 정치적 표현의 자유의 보장과 그 한계를 살펴보면 학생도 원칙적으로 언론의 자유의 주체가 될 수 있다. 그리고 국가가 이러한 언론의 자유를 제한하기 위해서는 헌법의 기본권 제한 요건을 충족하여야 한다. 또한 학칙의 규범력을 향상하기 위해서는 학교에서의 정해진 절차에 따라 학칙의 구체화가 필요하며, 학칙 구체화가 어려울 경우 상위 교육기관에서 표준 학칙 안을 제시하여 학교에서 반영할 수 있도록 하여야 한다. 교육이론적 관점에서는 선거권 관련 교육의 현황과 그 문제점, 개선방안을 제시하였다. 첫째, 고등학교 사회과 교육과정에서 선거권 관련 교육은 ‘사회’, ‘법과 정치’과목으로 볼 수 있으며 선거권 교육을 넘어 정치 참여 교육으로 확대되어야 한다. 둘째, 정치 내용적 요소, 사회 정책적 요소, 학교 정책적 요소의 주제를 다루는 토론 중심의 수업이 확대되어야 한다. 셋째, 사회과를 넘어 모든 교과 차원에서 민주시민교육이 강화되어야 한다. 넷째,「교육기본법」제2조의 표현을 정비하여 민주주의 교육이 우리의 교육목표임을 좀 더 분명하게 규정하는 것이 필요하며, 「교육기본법」제3장에서 국가와 지방자치단체가 민주주의 교육에 필요한 시책을 수립·시설하도록 책무를 부여하는 규정을 신설해야 한다. 다섯째, 학교에서의 학생 참여의 활성화를 위하여 학생들의 자치 공간 마련, 학교장과 간담회, 지역 학교 학생회 네트워크 형성 등 다양한 방법이 모색되어야 한다.
