It is the predominant view that a certain relationship between responsibility and prevention as purpose of punishment in the category of responsibility. I also think so, in the respective of the order of constitutional law and the task of criminal law. Then, how are the two linked each other? There are some views about this. For example, can be cited as significant ones of them the traditional perspective of responsibility, the preventive and the pure preventive. In this paper, based on the traditional perspective, I examined critically the latter ones, and in addition to them the other view, according to which the principle of responsibility in a traditional sense should be substituted for the principle of proportionality. It is my opinion that there are not a few or more problems in the preventive, especially in the pure preventive perspective in comparison with the traditional one, even though there are some problems in the traditional perspective, which can not be easily solved. Therefore, I think that these days should be maintained the principle of responsibility in a traditional sense and the method of establishing wrongdoer's responsibility according to it.

책임범주에서 책임과 형벌목적(예방사고) 간에는 어떤 관련성이 있는가? 이 물음에 대해서는 현재 다양한 시각이 존재하고 있다. 우리의 경우 이러한 문제는 그 동안 ‘책임과 예방의 관계’라는 논제 아래 적잖이 다루어지기도 하 였다. 하지만 논의의 치열함만큼 그에 따른 해결의 접점은 보이지 않고, 오 히려 우리의 현실을 들여다보면 위험사회로 규정되는 현대사회의 경향과 조 우하여 실천적으로는 이른바 예방형법의 위력이 점차 더 그 반경을 넓혀가고 있는 실정이다. 이러한 상황에 비추어 볼 때 형법상 그러한 예방사고의 중요 한 유입점이 되고 있는 ‘형벌’과 ‘책임’의 영역에서 이들의 본질과 성격을 되 짚어 보는 것은 충분히 의미 있는 일이라 여겨진다. 필자는 이 글에서 전통적인 책임원칙(혹은 책임관)과 그에 따른 책임규정 이 적지 않은 문제점을 지니고 있음에도 여전히 유효한 것으로 적용되어야 한다는 생각에 입각하여, 형벌목적으로서의 예방사고가 형법상의 책임범주와 관련성이 있는지, 만일 그렇다면 어떻게 관련되어 있는지를 재조명하고, 행 위자의 책임을 규정함에 있어 예방사고를 연계시키거나 책임과 그 내용을 아 예 그러한 예방사고에 입각하여 바라보려는 시도에 대해 비판적으로 검토해 보았다. 그리고 이를 통해 전통적인 책임원칙이 책임범주에서 차지하는 중요 성과 의의를 분명히 함과 동시에 제동이 풀린 열차마냥 질주하는 예방사고의 부정적 힘에 대해 다시금 성찰해보는 기회를 마련하고자 하였다.
