This Thesis is The main purpose of this study is to prove the possibility of intersubjective justification and explanation of Economic democracy in the jurisprudential horizon. This study is aimed at Economic democracy, that is a kind of legal system, to form an economic order with respect to the common will and opinions in a democratic civil society. In this context, Economic democracy will be explained by self-calibration learning process of the intersubjective citizens subject. For this purpose, I will want to diagnose the current situation of our country as 'democracy without democrats'(1). And I provide a description of the history of Economic democracy(2). Furthermore, from a philosophical interpretation of the 'democratization of the economy' as specified in Article 119 of the Constitution, I suggested that we achieve financial freedom and justice through the economic democratization(3). Then I tried to justify the Economic democracy as the critical norm of economic discourse(4). Finally, I examine briefly the three horizons of Economic democracy(5).

이 글의 주된 목적은 법철학적 지평에서 경제민주주의의 상호주관적 정당화와 해명의 가능성을 논증하는 것이다. 본 연구가 지향하는 경제민주주의는 ‘시민사회에서 민주적으로 형성된 공동의 의지와 의견으로 경제질서를 형성하고 규율하는 법체계’를 가리킨다. 이 맥락에서 경제민주주의는 상호주관적 시민 주체들의 자기 교정적 학습과정으로 해명될 것이다. 이를 위해 필자는 먼저 ‘민주주의자 없는 민주주의’로 현 상황을 진단한 다음(1), 경제민주주의와 관련된 개념사를 짧게 살펴보고(2), 헌법 제119조에 명시된 ‘경제의 민주화’에 대한 법철학적 해석을 수행하고자 한다(3). 이상의 기초연구를 토대로 필자는 하버마스의 2단계 사회이론과 법철학의 프레임을 빌어 경제민주주의를 비판의 규범적 원칙으로 정당화한 다음(4), 마지막으로 경제민주주의의 세 가지 지평에 대해 간략하게 살펴보고자 한다(5).
