The purpose of present study is actively to seek ways to utilize risk assessment tool for family violence in criminal justice system as an alternative and to analyze the validity of risk assessment tools for family violence. Family violence tend to be regarded as household affairs in Korea and has unique characteristics which are victims suppressing or minimizing crime facts. Therefore, objectivity of assessments on the family violence is important. Nevertheless such objective criteria on assessments isn't indicated in the criminal justice system. In foreign countries, The family violence risk assessment tools are already utilized in mainly police, correction and probation services to investigate and analyze family crimes accurately. The risk assessment tools can help to plan for safe separation of victim and perpetrator, to evaluate the optimal risk assessment or correctional method to offender and to determine the placement and its effectiveness of suspension. To carry out a proper and accurate intervention for the victim, we need the family violence risk assessment tools.

가정폭력 사건에 대한 형사사법적 의사결정을 보다 적정하게 수행할 대안으로서 가정폭력 위험성 평가도구의 활용을 적극 고려하면서, 이 분야의 전문평가도구에 대한 타당성을 검토하였다. 한국에서 가정폭력은 ‘집안 일’로 치부되는 경향이 있으며, 피해자 역시 피해 사실을 숨기거나 축소시키려는 특이성이 있기 때문에 가정폭력 범죄에 대한 객관적인 평가가 중요할 수밖에 없다. 외국에서는 주로 경찰, 교정 및 보호관찰 서비스에서 가정폭력 위험성 평가도구를 활용하고 있다. 위험성 평가 도구는 피해자를 안전하도록 즉각적인 분리 계획 설정, 범죄자 처분 결정, 교정 방법 계획 설정, 집행된 처분의 효과성 확인에 도움이 될 수 있다. 따라서 사법기관의 집행자들에게 객관적인 평가 방법을 제시하여 피해자들을 위해 적극적으로 개입할 수 있도록 위험성 평가 도구의 활용을 촉진하는 것이 필요하다.
