It is required to ensure the principle of fairness as in the concepts of 'distributed justice' to enhance the general quality of life in international society and to contribute to sustainable development, besides taking the principle of non-discrimination based on market economy principles and equality among participating countries according to WTO laws as one of the major principles. In the interests of economically non-equivalent countries, mutual cooperations need to be promoted as an effort to improve inequalities and to minimize antagonization and conflicts. To prevent uneven profit sharing among countries under 'different conditions' and to respect the concept of substantive equality required by many countries, it is important that the WTO laws are based on the concept of substantive fairness. Especially it is meaningful to review the details of sustainable development principles and their enforceability on the basis of substantive fairness in WTO laws. Furthermore, it the importance of sustainable development principle is required strongly by virtue of being intensified the seriousness of environmental damage and unlimited utilization of natural resources. In the viewpoint, the principle of sustainable development is likely to consider into theoretical base according to transfer substantive equality into substantive fairness. The principle of substantive fairness to realizing substantive equality ‘between countries where the same conditions do note prevail'should be actualize by enforeceability of the material implication of sustainable development.

WTO법에서 무역자유화를 촉진하기 위해 시장경제 원리와 국가들 간의 동등성에 기초한 비차별주의를 주요 원리로 삼는 것 외에도, 전반적인 삶의 질적 향상과 지속가능한 개발을 달성하기 위해 분배적 정의 관념에서의 공정성 원칙의 보장이 요청된다. 동등하지 아니한 국가들 간의 계속되는 대립과 갈등을 최소화하고 불평등성을 개선하기 위해 상호간의 협력이 촉진되어야 한다. 국가들 간에 이익의 편중을 완화하고, 동등하지 아니한 국가들 간에'(between countries where the same conditions prevail) 차등대우의 기초가 되는 실질적 평등 개념을 구현하기 위해, WTO법상 실질적 공정성 개념으로 제 원칙을 적용하는 방안이 검토되어야 한다. 이러한 관점에서 실질적 공정성의 이론적 토대로 지속가능한 개발 원칙의 세부적 원리들과 이행 가능성에 관한 검토는 필요할 것이다. WTO 협정전문에 기술된 지속가능한 개발 원칙은 무제한적 자원의 사용과 환경훼손 및 파괴의 심각성의 폐해를 시정하고 친환경적이고 지속가능한 상태에서의 무역자유화가 이루어지도록 해야 함을 강조하는 것이다. 이에 WTO법상 실질적 평등을 구현하기 위한 접근으로 실질적 공정성(substantive fairness)을 원칙으로 적용하고, 이러한 원칙의 이론적 토대로 지속가능한 개발의 제 원리들을 원용하는 것이 요청된다.
