There are programmes of foreign aid and international free movement to solve the problem of international inequality. If we select the way of international free movement we meet the problem of membership related to open borders. R. Nozick’s libertarianism approaches to the problem of membership on the position of calculative rational selection. If it is profitable for existing members of community to regard foreign labours as temporary visitors the libertarianism may not approve to give them membership. If J. Rawls’s egalitarian liberalism pursues its ideals such as universalism and egalitarianism thoroughly it ought to take a open attitude toward the problem of membership. Especially if we receive positively principle of justice such as difference principle we should approve the membership of foreign labours whether their visiting is legal or illegal. If they agree to the principles of justice or the essentials of constitution it is not proper to disapprove their membership. M. Walzer’s communitarianism insists that membership of community should be given to existing members and they should close borders to maintain the values and traditions of community except particular cases. He insists that we should give citizenship to foreign labours visiting legally because we approved their visiting for our needs. Although we don’t uphold P. Singer’s utilitarian radical opinion we should take a more open attitude. It is desirable that we should open a border to urgent people such as refugees beyond the viewpoint of calculative rational selection or preservation of community values. And it is proper to approve citizenship of foreign labours visiting illegally because we often tacitly approve their employment and make bad use of their bad circumstances.

국제적 불평등의 문제를 해결하는 방식에는 해외 원조와 더불어 자유로운 해외 이주가 있다. 그런데 해외 이주의 방식에서는 국경의 개방과 관련하여 성원권 문제가 발생한다. 이러한 성원권 문제에 대해 노직의 자유지상주의는 이해타산적인 합리적 선택의 관점에서 접근한다. 따라서 외국인노동자들을 임시적인 체류자로 묶어두는 것이 기존의 구성원에게 이익이 된다며 그들에게 성원권을 부여하지 않을 가능성이 높다. 롤즈의 평등주의적 자유주의는 그 이념이 함축하고 있는 보편주의와 평등주의를 충실히 따른다면 국제적 불평등을 해결하기 위해 성원권에 대해 개방적인 태도를 취해야 한다. 특히 정의의 원칙으로 내세운 차등의 원칙을 적극적으로 적용한다면 외국인 노동자가 합법적으로 입국하였든 불법적으로 입국하였든지 간에 그들의 성원권을 인정하는 것이 마땅하다. 그들이 정의의 원칙이나 헌법의 본질적 요소에 동의한다면 그들의 성원권을 불인정하는 것은 옳지 않다. 왈쩌의 공동체주의는 성원권이 기본적으로 내부 구성원들에게 있으며 공동체의 가치와 전통을 유지하기 위해서는 특수한 경우를 제외하고는 국경을 폐쇄해야 한다고 본다. 그는 합법적으로 체류하는 외국인 노동자는 우리의 필요에 의해 입국을 승인하였기 때문에 그들에게 시민권을 부여해야 한다고 본다. 우리가 국경선의 전면적인 개방을 주장하는 싱어의 공리주의적인 급진적 견해에 동조하지 않는다고 할지라도 성원권 문제에 대해 좀 더 개방적인 태도를 취할 필요가 있다. 난민과 같이 절박한 상황에 있는 사람들에게 이해타산적인 합리적 선택이나 공동체의 가치 보존이라는 관점을 넘어서서 생명권을 비롯한 인권의 보장을 위해 그들에게 국경을 개방하는 것이 바람직하다. 그리고 불법적으로 입국한 외국인 노동자라고 할지라도 그들의 취업을 묵인하고 그들의 열악한 상황을 악용하여 착취하는 경우가 많기 때문에 그들에게도 시민권을 부여하는 것이 마땅하다.
