The main purpose of this study is to narrow the gap between academic opinions and policies for lifelong education system, by analyzing problems and trying to seek the improvement. To achieve this goal, we reviewed the purposes and provisions of 11 legislative bills for lifelong education law submitted to the 18th National Assembly and discussed the direction for revision based on the scholar's debate about the limitation of lifelong education law. The study shows that only one bill regarding learning accounting system was passed among 11 legislative bills. However, the role and function of the executive organization for learning accounting system suggested by the related study was insufficiently reflected. The legislative bills that submitted in the 18th National Assembly included the act of populism which forces the government to provide free meals to lifelong education facility and to support the schools for the aged. The study also points out the limitation of lifelong education law. In particular, the lifelong education has been demanded the reorganization according to the limitation of executive area. Therefore, lifelong education law should be amended as a lifelong learning law, adult education law should be enacted and declaratory provisions have to be revised effectively.

본 연구는 현 평생교육제도에 대한 학(學)-정(政) 간의 거리와 방향을 좁히고 일치시 키기 위해 학(學)-정(政) 간의 차이를 분석하고, 이의 개선방향을 모색하는 데 그 목적 이 있다. 이를 위해 제18대 국회에서 발의 제출한 11건의 평생교육법 일부 개정법률안 의 실제 개정취지와 조문별 내용을 고찰하였고, 현 평생교육법의 한계에 대한 학자들의 논의를 토대로 향후 개정방향에 대한 논의를 정리하였다. 연구결과 개정법률안 11건 중 의결된 것은 학습계좌제 관련 법률안 1건으로 나타났 으나, 관련 연구에서 제시된 학습계좌제 실행기구의 역할과 기능제시가 미흡하게 반영 되었다. 11건의 제출된 법안에는 평생교육시설의 급식과 노인학교 지원을 강제하기 위 한 무리한 포퓰리즘 법안도 있었다. 현 평생교육법 개정에 대한 요구와 개선방향으로 평생교육 개념의 한계와 기본법으로서의 내용의 한계를 지적할 수 있다. 특히, 실천영 역 으로서의 평생교육의 문제점을 극복하기 위해 평생학습법과 성인교육법으로의 분류로 재구조화 방안을 제시해 본다. 또한 평생교육법 내용의 의무조항 강화와 상징적 선언적 의미의 법 조항을 실효성있게 개정을 제안한다. 아울러 타 법과의 중복과 충돌 부분에 따른 위헌문제를 불식시키기 위해 조속히 관련학자들의 재개념화 요구를 수용한 개정 법 률안이 발의되어야 할 것이다.
