Corporal Punishment has a important meaning especially in our educational circumstances. So far, most argumentations on the justifiability of the corporal punishment have concentrated on the educational effects of it. But to illuminate this problem, it is not enough only to discuss it in the level of effects, because more fundamental philosophical issues lie under it.
First of all, the justifiability of the corporal punishment can be investigated in the context of theory of punishment which is one of the most important part in the ethics. There are two main currents to access the problem of punishment. One is the approach of utilitarianism, which concentrates on the effects. But not only for the defects of utilitarianism itself, but also for the difficulties in the objective verification of the effects, it faces some troubles.
So it is necessary to try the other approach that is called the retributive theory. Here, it should be examined whether our body can be the objects of the punishment. Traditional rationalist say ‘No', because they believe the mind is the only subject. But some of modern western philosophers including Merleau-Ponty say ‘Yes’, because they think that the body, constructed by interaction with the world, can be the subject. On the basis of this view, corporal punishment can be justified.
Finally, We can approach the problem from the viewpoint of social ethics. Here the concept of human right is a fundamental principle. Especially the rights of the youth should be considered seriously. Insofar as the corporal punishment doesn't harm to the human right, it can be justified.

체벌은 우리 학교 교육에서 중요한 교육 수단의 하나로 인정되어 왔다. 그런데 체벌의 정당성에 대한 논의는 주로 교육의 성과와 연관해서 체벌이 어떤 긍정적 혹은 부정적 효과를 갖는가 하는 문제에 집중해왔다. 그러나 체벌 문제는 단순히 효과에 대한 논의만으로는 올바른 접근이 쉽지 않은 문제이다.
왜냐하면 체벌과 연관해서는 인간을 어떻게 보느냐 하는 인간관의 문제 및 우리 몸이 가지고 있는 의미가 무엇인가 하는 등의 좀 더 근본적인 철학적 문제들이 제기될 수밖에 없기 때문이다.
체벌의 정당성 문제는 윤리학에서는 크게 세 가지 맥락에서 검토될 있다. 우선 윤리학의 핵심적 주제 중의 하나인 처벌 문제의 맥락에서 검토될 수 있다. 처벌 문제에 접근하는 철학적 입장으로는 공리주의와 응보주의가 대표적이다. 먼저 공리주의 관점에서는 체벌이 처벌로서의 효과가 있는가 하는 문제가 쟁점이 된다. 따라서 교정의 효과 및 예방의 효과 여부가 정당성 논의의 핵심이 되어 이를 놓고 체벌긍정론과 부정론이 대립하게 된다. 그러나 공리주의적 접근은 공리주의 자체의 약점 외에도, 체벌의 효과가 상대적이고 유동적이기 때문에 효과에 대한 객관적 검증이 쉽지 않다는 어려움에 직면하게 된다.
따라서 응보주의의 관점에서 체벌의 정당화 문제를 검토해 볼 필요성이 생기는데, 이때 중요한 문제는 몸이라는 것이 과연 처벌의 정당한 대상일 수 있는가 하는 것이다. 전통적 합리주의의 인간론은 인간정신을 주체로 본다. 그러나 메를로-퐁티를 비롯한 일군의 철학자들은 몸에 대한 새로운 철학적 이해를 바탕으로 구조화되고 습관화된 몸이 진정한 주체라고 주장하고 있다. 이런 입장에 근거할 경우 응보주의의 관점에서 체벌이 정당화될 기초가 마련된다.
세 번째 가능한 접근 방식은 사회 윤리적 접근으로서 이미 보편적으로 확립된 ‘인권’개념과 체벌이 조화될 수 있는지 살펴보는 것이다. 이 때, 인권 침해 없이 체벌이 시행될 수 있는 조건이 현실적으로 마련될 수 있으며, 또한 그런 조건에 관련 당사자들이 동의할 수 있다면, 체벌의 정당성은 확보될 수 있을 것이다.
