The purpose of this study lies in analysing the trend, the causes, and the traits of formal crime control in Korea that have emerged over the past three decades. I seek to propose theoretical perspectives and examine main changes in crime control of the Western countries in order to map out the patterns and the trends in crime control in Korea. To analyse practice of the control policy, I used government's official crime statistics. The results show that the rates of imprisonment decrease, while practices of community-based treatments increase through the years. However, the state regulates the rates of imprisonment by parole, pardon, or bail system because of the limit of the imprisonment capacity and the lack of imprisonment cost especially in periods of president Chun and Roh's regime between 1980 and 1992. After 1993 community-based treatments have been widely practiced in terms of rapid decreasing of imprisonment rates. This study could not find any evidence of government's regulation about crime control to maintain balance of imprisonment rates in this periods. However, the policy of crime control which is based on bloody code have continued consistently. In doing so, there are still a lot of discrepancies between policy of crime control and its current practice in Korea.

이 글은 한국사회의 범죄통제의 성격 변화에 대해서 최근 30년간 공식적인 범죄통제가 변화해 온 주된 추세와 요인을 분석하고 범죄통제 정책의 변화와 실재를 설명해 본 것이다. 범죄통제의 이론적인 배경과 범죄통제체계의 발전과정을 살펴 본 후 정치권력과 범죄통제의 연관성과 국가의 범죄통제정책의 기조가 무엇인지를 검토하였다. 그 결과 구금시설의 수용능력의 한계와 유지비용의 문제로 인해 국가는 가석방과 사면, 보석 등을 통해 전체 구금인원을 조절하는 측면이 있음을 알 수 있었다. 그리고 이러한 사실은 전두환 노태우 정부시기인 1980년에서 1992년 사이에 더욱 두드러졌다. 반면에 1993년 이후에는 구금율이 급속하게 줄어들어 사회내 처우가 본격적으로 실시되고 있음을 알 수 있었다. 이 시기에 이르러서야 국가가 조절의 수단으로 범죄통제를 이용하는 것이 줄어들기 시작함으로써 범죄통제 정책의 변화가 나타났다. 그렇지만 여전히 우리나라의 범죄통제는 중형주의를 바탕으로 한 정책적인 기조는 흔들리지 않고 유지되고 있지만, 그 정책의 실행적인 측면에서는 정책적인 표방과는 달리 일치되지 않은 모습을 드러내고 있다.
