This paper first investigated various statistic records on the sex crime against children in order to confirm whether its occurrence should increase. Also, recent judicial policies against this crime and attempted to find out where the flaws of policies, not to reduce sex crimes against children. Since the problems were concluded to exist in investigation system, it was suggested to how to resolve this problem. In this study recommended statement validity analysis performed by experts on victims' report at the investigation stage. Finally, opinions of 13 judges were gathered and analysed on applicability of experts' statement validity analysis. All of them reported statement validity analysis might be helpful for their judicial decision making.

본 연구는 최근 증가추세에 있는 국내 아동 대상 성폭력 사건의 실태를 살펴보고 그에 대한 범죄통제 정책의 집행에서 취약점을 극복할 수 있는 방안을 모색하였다. 이를 위해 일단 현재의 정책적 방향을 분석하고 법원의 관련 사건에 대한 판례 추이를 살펴보았다. 국내 제도에서 관찰된 문제점을 중심으로 하여 그와 관련된 외국의 제도를 조사함으로써, 현재 국내 사법제도에서 도입할 수 있는 좋은 대안은 무엇인지 모색하였다. 마지막으로 본 논문에서 대안으로서 제안하고 있는 전문가에 의한 이동 피해자 진술타당성분석 및 감정제도에 대해 현직 판사들은 어떤 의견을 지니는지 알아보았다. 답변에 응하였던 모든 판사들은 피해 진술에 대한 진술타당성 분석이 의사결정에 도움이 된다고 답변하였다.
