Public opinions serve as a pillar of the democracy. Indeed, the formation and distribution of public opinions are sharply influenced by the media. While public opinions play a pivotal role in the development of a democratic sphere, monopolized public opinions by a few mainstream newspapers can eventually do the same harm to the democratic values as opinions which are politically-oriented and, distorted or manipulated. It is beyond question that the diversity and dynamics of opinions must be secured to develop and sustain a more robust democracy. As substantive premises, the diversity of opinion requires the diversity of the media contents and media pluralism as well as multiple numbers of newspapers and other channels. Based on the perspective that the newspaper industry's decline can lead to the crisis of the diversity in public opinions and democratic systems, the study examines the need for developing support systems within constitutional boundary. This research, conducted through the examination of literature cited and the decisions of the Constitutional Court, finds that the function of newspapers articulated in Article 21, section 3 of the Constitution indicates the guaranteed diversity of newspapers.

여론은 민주주의 시스템 유지하고 발전시키는 동맥이다. 여론의 형성과 유통은 미디어에 의해 크게 영향을 받는다. 소수의 강력한 미디어들이 한 사회의 지배적인 여론을 형성하고 독과점인 유통망을 장악하는 한, 그러한 여론은 정치권력에 의해 오염된 여론이나 조작․왜곡된 여론과 마찬가지로 민주주의 시스템에는 해악이 될 뿐이다. 여론이 건강한 민주주의의 유지와 발전에 기여하기 위해서는 여론의 다양성이 확보되어야 한다. 여론의 다양성은 미디어의 다양성을 전제로 한다. 미디어의 다양성은 외적 채널, 신문 제호의 다양성 뿐만 아니라 생성․유통되는 미디어 내용의 다원성, 다양성을 담보해야 한다는 것을 의미한다. 이 연구는 우리 헌법 제21조 3에서 규정하고 있는 신문의 기능이 신문의 다양성 보장을 의미한다는 점을 제반 문헌자료와 헌법재판소 결정을 통해 확인하고 있다. 신문산업의 위축은 여론다양성과 민주주의 시스템의 위기로 연결된다는 관점에서 신문산업을 진흥시키기 위한 헌법적 테두리 내의 각종 지원제도의 정당성을 고찰하고자 하였다.
