The purpose of this study is to explore the relationship between democracy and fair election. Especially, it focuses on the roles of National Election Commission(NEC) and the voters for the settlement of fair election. According to the results of post-election survey, first, the positive evaluation for the fairness of election management by the NEC have been maintained. Second, statistically significant differences were founded in the fairness of election management by age, education, income, ideology. Third, there was significant difference in the 2007 presidential election by sex, unlike the 2002 presidential election. The major future tasks of the NEC is to be evaluated equally by the winner and the loser. Specifically, this study suggests the reinforcements of management function of the NEC, candidate verification service, quick answering to inquiry, and protection from negative campaign through the settlement of manifesto policy campaign. In addition, this study suggests the following things as role of voters for the settlement of fair election: doing activities that do not select candidates who launched illegal campaign, active participation in voluntary activities for fair election and in reporting violator of election laws.

본 연구는 민주주의와 공명선거를 관계를 고찰하는데 있다. 특히, 공명선거 정착을 위한 중앙선거관리위원회와 유권자의 역할에 중점을 둔다. 2007년 대선과 2002년 대선직후 한국선거학회한국사회과학데이터센터가 실시한 국민여론조사 결과, 첫째, 선관위의 선거 관리 공정성에 대한 높은 긍정적인 평가가 유지되는 추세이다. 둘째. 연령별, 학력별, 소득별, 이념성향별로 선관위의 선거 관리 공정성에 대한 평가에서 통계적으로 유의미한 차이가 발견되었다. 셋째, 20022년 대선에서는 성별로 차이가 나타나지 않았지만 2007년 대선에서는 통계적으로 유의미한 차이가 발견되었다. 여성보다는 남성에서 적극적 긍정 평가 비율이 높았다. 중앙선관위의 향후 과제의 핵심은 승자와 패자 모두에게 선거관리 공정성에 대해 균등하게 평가받는 것이다. 구체적으로 살펴보면, 선관위의 관리 기능 강화, 후보 검증 서비스 강화, 문의사항 답변 기능 강화, 매니페스토 정책 선거 정착을 통한 네거티브 선거 운동 차단 등이 해법으로 제시된다. 공명선거 정착을 위한 유권자의 역할로써는 불법 선거운동을 한 후보에게 표 안주기 실천, 공명선거 자원 봉사 활동에 적극 참여, 선거법 위반 제보신고에 적극 참여 등을 제시한다.
