Many fraud cases including Internet fraud, can be classified in terms of Modus Operandi and deceit tactics which is common to all kinds of fraud, thereafter we may find any useful clues for prevention of fraud victimization. The deceit tactics in fraud can be divided roughly into five classes, such as enticement, scare, mystery, good faith and the other emotion tactics. First, It leaves much room for discussion as to whether the fraud victim by enticement tactics is to be blamed for his greed, vanity and so on, to what extent. But those who are victimized by the rest of tactics should not be the target of reproach, otherwise generally wrong preconception would just let the offender use neutralization skills and make victims unwilling to report the crime and feel helpless. It is likely to lead the law enforcement agency who is responsible for fact finding into taking negative attitude to the given case with a distorted point of view. Second, different responses may be done according to each deceit tactic. And lastly, reporting system should be improved so that victims can feel like complaining more easily. Apparently fraudsters are masters at instilling a false sense of fear, shame, and guilt in their victims who is chosen and manipulated carefully. The rates of reporting frauds remains low with ultimate result desirable to perpetrators. A more elaborate intervention in victimizing process and a more effective assist to fraud victims may reduce the risk of becoming a victim of fraud and help victims get their life back on track.

사기피해 사례들을 수법을 중심으로 고찰하고 사기 피해자화에 공통적으로 적용되는 여러 가지 기망전술을 유형적으로 분석한 후에 사기범죄의 피해예방책을 위한 일련의 단서를 찾는 것이 요망된다. 모든 종류의 사기에서의 구성요소인 기망전술을 크게 다섯 가지 즉, 유인전술과 공포전술, 그리고 신비전술, 거래신의칙, 기타 감정 전술로 대별할 수 있다. 이를 통해 얻을 수 있는 시사점으로는 그 중에서 ‘유인’을 본질로 하는 기망에서는 사기피해자의 책임 및 그 정도를 따져볼 여지가 있으나 그 외의 기망전술에 있어서는 사기피해자도 책임이 있다는 일반적 선입견에 의해 사기수법의 악질성과 교묘성이 희석되지 않도록 해야 한다는 점과 사기예방대책은 기망전술의 범주에 따라 다르게 이루어질 수 있다는 점, 그리고 신고율제고를 위해서는 피해자지원과 병행하여 신고 및 고소․고발이 용이하도록 기관 및 단체와의 공조가 필요하다는 점이다. 피해자에 대한 부정적 시각이 통용되는 분위기에서는, 사기범죄자가 「중화」기술을 통해 피해자의 신고의지를 꺾거나 무력하게 만드는 길을 열어주는 결과가 되고, 사법기관의 왜곡된 시각에 의해 실체적 진실발견의 의지가 약화될 수도 있게 된다. 앞으로도 사기 수법은 새롭게 등장할 것이고 피해자를 기망하는 기본 전술은 여전히 통용될 것이다. 수사기관에서는 사기미수에 대해 더 적극적이어야 하고, 일반법집행기관에서는 사기예방 내지 저지차원에서 피해자화 과정에 적절하게 개입하여 피해를 중단시켜야 하는데, 가장 효율적인 것은 그 중 기망이 이루어지는 초기단계에서 개입하는 것이다.
