Many debate sites are opened on the internet lately and often there are replies that defame one's character. In the cases of defamation of character liability on the internet debate sites, as with cases of other on-line service providers, it is difficult to trace the wrongdoers directly. Even in the cases when wrongdoer is identified, there are many times the wrongdoer turn out to be ineffectual and the victim can not be salvaged realistically. And for that reason victim will seek
salvation against internet debate site operator with its own exertion.
Also when debate site operator is aware of the reply that is defaming one's character is on their internet debate site and neglect such reply would be same as conspiring with the defamation of character and if so, should the debate site operator be liable can become the issue of
discussion. Thus this thesis will look into development and function of debate culture on the internet and study when two of benefit and protection of the law which is freedom of expression on the internet and defamation of character crashes how the matter should be mediated. Moreover, in case when defamation of character does occur on the internet debate board, whether to lift or reduce the liability for the operator who provided the debate board would be the main issue of the discussion.

요즘 많은 인터넷 사이트에는 토론방이 개설되고 있는데, 그러한 토론방에 타인의 명예를 훼손하는 글을 올리는 경우가 많다. 인터넷 토론방에서 이루어지는 명예훼손의 경우에는 다른 온라인서비스제공자의 경우와 마찬가지로 직접 가해자인 행위자를 추적 할 수 없는 경우가 많다. 행위자를 알 수 있는 경우에도 그 행위자가 대개 무자력하여 피해자가 그 행위자로부터 실질적인 구제를 받을 수 없는 경우가 많을 것이다. 이러한 이유 때문에 피해자는 자력이 있는 인터넷 토론게시판 운영자를 대상으로 피해구제를 하려고 할 것이다. 또한 타인의 명예를 훼손하는 글이 인터넷 토론게시판에 올려진 것을 알고도 토론게시판 운영자가 계속 방치하여 둔다면 이 역시 가해자의 명예훼손행위에 가담한 것이나 마찬가지이므로 인터넷 토론게시판 운영자에게도 법적 책임을 물을 수 있는지가 하나의 논의의 쟁점이 될 수 있다. 따라서 본 논문에서는 인터넷상에서의 토론 문화의 발전과 기능을 살펴보고, 사이버공간에서의 표현의 자유와 명예훼손의 두 법익이 충돌하는 경우 어떻게 조정되어야 하는가에 대하여 고찰 해보기로 한다. 나아가 인터넷 토론게시판에서 명예훼손행위가 발생한 경우 그 장소를 제공한 토론게시판 운영자의 책임을 면제 또는 감경할 수 있는지의 문제를 주요 논의의 대상으로 한다.
