In this thesis, I studied major subjects of the Act on Fair Trade Practices in Franchising(2007 revised)(hereinafter "revised Franchising Act") and the revised bill of the enforcement ordinance in regard to this Act. The enrollment system of disclosure of information, escrow system, and renewal system of franchise contract etc. were introduced to the revised Franchising Act in order to prevent the side effect which could come from unbalance of information between a franchisor and a prospective franchisee in franchising. The revised Franchising Act has expanded the scope of a recipient of disclosure of information and extended the period of consideration of disclosure of information of a prospective franchisee.I explained the contents and purport of the revision and analyzed a point at issue. I think legislators had done their best to moderate the conflict between franchisor and franchisee for their mutual advantage. I proposed my opinion in relation to the point of dispute on the revised Franchising Act and the revised bill of enforcement ordinance accompanied with this Act.

2007년 개정 ｢가맹사업거래의 공정화에 관한 법률｣의 주요내용을 동법 시행령개정(안)의 내용과 함께 검토하였다. 개정가맹사업법은 가맹사업거래에 있어서 가맹본부와 가맹희망자 또는 가맹점사업자간 정보의 불균형으로 인하여 발생할 수 있는 부작용을 예방하기 위하여 정보공개서 등록제, 가맹금 예치제 및 가맹계약 갱신 요구 제도 등을 도입하였다. 또한, 정보공개서 제공대상범위를 확대하고 가맹희망자의 정보공개서 숙고기간을 연장하였다. 개정 부분과 관련하여 개정의 내용을 소개하고, 개정의 취지를 설명하면서 해석론적 쟁점을 추출하여 분석하였다. 그 과정에서 가맹본부와 가맹점사업자 사이의 이익을 적절히 조화시키려는 입법자들의 노력을 엿볼 수 있었다. 개정가맹사업법과 동법시행령개정(안)에서 입법자들과 의견을 달리하는 부분에 관하여 필자의 의견을 제시하였다.
