Recently, it has been a hot issue to discriminate disqualified teachers, under the public education system surrounded by the education-related stakeholders in a pluralistic society. The study was intended to analyze teachers' resistances of discriminating disqualified teachers, and to suggest policy directions for improving their discriminations. For attaining the purpose this study reviewed the related literature with the disqualified teacher from the various perspectives and found that we need to discriminate disqualified teachers through the establishment of a minimum standards for teachership. Derived from the review of the literature from teachers' resistances against educational changes, the scopes of analysis were composed of (1) cultural barrier, (2) social barrier, (3) organizational barrier, (4) psychological barrier. As a result of applying the barriers into the cases of discriminating disqualified teachers, the study suggested the following policy implications: (1) setting justifiable and objective criteria of discriminating disqualified teachers, (2) exploring rational approaches and methods to strengthen the positive sides of the discriminating system, and (3) Using different policy mechanisms in the process of its formation and implementation.

부적격 교원의 문제가 사회적 쟁점으로 부각되면서 교육인적자원부는 ‘학교 교육력 제고를 위한 협의회’를 구성하여 학생의 학습권과 해당 교원의 권익을 보호할 수 있는 대책을 마련하고자 하였다. 그러나 부적격 교원을 어떻게 판별할 것인가에 대한 기준 설정을 둘러싼 이해집단간의 갈등으로 인해 난항을 거듭할 수밖에 없었다. 본 논문에서는 교원이 갖추어야 할 최소한의 기준 설정의 중요성과 부적격 교원 판별 문제를 수용하는데 있어서 교원들의 저항원인은 무엇인가에 터하여 부적격 교원 판별 문제에 따른 교원들의 저항을 분석하고 해소하기 위한 방안을 탐색하고자 하였다. 이를 위하여 먼저 부적격 교원의 개념과 유형을 고찰하였고 외국의 부적격 교원의 개념과 대책에 대한 선행연구들을 살피면서 연구동향을 알아본 다음 교원이 갖추어야 할 최소한의 기준 설정으로서 부적격 교원 판별 문제가 필요하다는 전제를 하였다. 또 이를 바탕으로 이해당사자의 핵심인 교원들의 변화에 대한 저항원인을 ① 문화적 장벽, ② 사회적 장벽, ③ 조직적 장벽, ④ 심리적 장벽(Zaltman et al., 1977)으로 설정하여 부적격 교원 판별 문제에 대한 교원들의 저항원인을 분석하고 해소방안을 제시하였다.
