This study examines the operational status of the indirect compulsory enforcement system, a mechanism for ensuring the effectiveness of administrative appeal rulings, and proposes institutional improvements. The analysis revealed that 75% of granted decisions were concentrated on a specific redevelopment association non-compliance with the duty to apply for an adjudication on compensation, confirming the system significant role in correcting repeated failures by quasi-administrative bodies. The Commission was also found to apply differentiated compliance periods and compensation amounts depending on the case. While the system is effective, several limitations were identified: ambiguity in the criteria for calculating compensation, the absence of aggravated penalties for habitually non-compliant entities, and the Commission’s passive post-decision management. To address these issues, the study proposes establishing specific criteria for compensation, introducing a system of aggravated penalties, and strengthening the Commission’s active post-decision monitoring of compliance.

본 연구는 행정심판 재결의 실효성 확보 수단인 간접강제 제도의 운영 실태를 파악하고 개선 방안을 제시하고자, 2024년 경기도행정심판위원회가 인용한 8건의 간접강제 결정을 심층 분석하였다. 2017년 도입된 간접강제 제도는 재결 불이행 시 배상금을 부과하여 피청구인의 의무 이행을 유도하는 제도이다. 분석 결과, 인용 결정의 75%가 특정 재개발조합의 ‘보상금 재결신청 불이행’ 사건에 집중되어, 제도가 준(準)행정주체의 반복적인 의무 해태를 시정하는 데 중요하게 기능함을 확인했다. 또한 위원회는 사건 유형에 따라 이행 기간과 배상금액을 차등 적용하고 있었다. 그러나 현행 제도는 배상금액 산정 기준의 불명확성, 상습적 불이행에 대한 제재 미비, 위원회의 소극적 사후 관리 등의 한계를 보였다. 이에 개선 방안으로 배상금 산정 기준 구체화, 상습 불이행 기관에 대한 가중 배상 도입, 위원회의 적극적인 사후 관리 강화를 제시하였다.
