This study presupposes and assumes that there is a risk of rapid development of AI technology and unexpected new types of crimes, and discusses how far police should be allowed to use AI for investigation and security maintenance, and whether AI should be regulated and controlled in order to respond quickly. Specific research issues include analyzing current AI use and misuse cases by Korean police, what AI-related security and investigation techniques can be used by police under the current law, and improvement plans for the introduction of advanced AI-based investigation techniques to effectively respond to emerging new crimes. In addition, we compared and analyzed high-risk AI in Europe and our high-impact AI, followed by AI technology used in police investigations and how to apply AI-based criminal investigation technology by overseas police in Europe and the United States to Korea. Finally, a legislative proposal was made to provide a specific legal basis for the use of AI-related technologies in criminal investigations, suggesting matters for the police to consider before using AI. Specifically, AI human rights education was presented in the police human rights protection rules and the proposed revision of the police officer's job execution law, which prevents police officers from relying too much on AI, and establishes police equipment provisions using artificial intelligence technology.

이 연구는 AI 기술의 급격한 발전과 생각지도 못한 신유형의 범죄가 발생할 우 려가 있을 것으로 전제·상정하고, 이에 신속 대응하고자 경찰이 수사 및 치안유지 에 AI를 어디까지 활용하도록 허용해야 하는지, AI를 규제·통제해야 할 필요는 없 는 것인지를 논하고자 한다. 구체적인 연구의 쟁점으로는 현재 우리나라 경찰의 AI 이용 사례와 오용 사례를 분석하며, 현행법하에서 경찰이 사용할 수 있는 AI 관련 치안 및 수사 기법은 어떠하며, 새롭게 등장하는 신종 범죄에 효과적으로 대 응하기 위한 AI 기반의 첨단수사 기법의 도입을 위한 개선안을 제시하고자 하였 다. 또한, 유럽의 고위험 AI(high-risk AI)와 우리의 고영향 AI를 비교·분석하였으 며, 이어서 경찰 수사에 활용되는 AI 기술과 유럽, 미국 등 해외 경찰의 AI 기반 범죄 수사 활용 기술을 국내에 적용하는 방안이 어떠한지를 살펴보았다. 끝으로 경 찰이 AI를 활용하기 전 고려할 사항을 제시하며, 범죄 수사상 AI 관련 기술의 활 용에 구체적인 법적 근거를 마련하려는 입법론적 개정안을 제시하였다. 대표적으로는 경찰관이 AI에 의존하지 않도록 하며, 인공지능 기술을 활용한 경찰 장비 조항을 신설하는 경찰관 직무집행법 개정 제안과 경찰인권보호규칙에 AI 인권교육과 관련된 근거규정을 마련할 것을 제안하였다.
