This paper examines how the interpretation and application of the security exceptions under the WTO Agreements have evolved in tandem with shifts in the international order —from the Cold War and post–Cold War eras to the emerging “New Cold War.” During the Cold War, GATT member states exercised considerable restraint in invoking the security exception, reserving it largely for matters relevant to military security in the conventional sense. A similar pattern of self-restraint continued throughout the post–Cold War period, when the ideals of trade liberalization and a rules-based multilateral trading system remained dominant. In contrast, in the New Cold War era, the invocation of security exceptions has become increasingly common, as states seek to justify various trade, industrial and technology policies using the rubric of “economic security.” This shift reflects deeper structural transformations in the global trading system, including the blurring boundary between economy and security, the growing strategic salience of dual-use technologies, and the paralysis of the WTO Appellate Body. The paper contends that this proliferation of security-based trade measures is not a mere aberration but a manifestation of systemic forces, and highlights the need for institutional reforms that can prevent abuse while maintaining a workable balance between national security and multilateral trade disciplines.

본 논문은 WTO 협정상 안보예외조항의 해석과 운용이 냉전 - 탈냉전 - 신냉전의 국제질서 변동 속에서 어떻게 변화했는지를 분석한다. 안보예외조항은 냉전기에는 군사안보 중심의 협 소한 예외로 자제적으로 운용되었으며, 탈냉전기에는 자유무역과 규범질서 확립 속에서 그 활용이 제한적이었다. 그러나 신냉전기에 들어 경제안보와 기술패권경쟁이 심화되면서, 안보 예외는 각국이 자국의 산업·기술정책을 정당화하는 수단으로 남용되는 양상을 보인다. 이러 한 변화는 경제와 안보의 경계 붕괴, 이중용도 기술의 전략적 민감성 확대, WTO 상소기구 기능 정지 등으로 나타난 국제통상 질서 전반의 구조적 변화에서 비롯된 것으로 평가된다. 본 연구는 안보예외조항의 남용이 일시적 현상이 아니라 구조적 요인에 기인한 것임을 밝히 며, 이에 대응하기 위한 제도적 개혁의 필요성을 제시한다.
