The Constitution establishes democracy as its fundamental principle, with popular sovereignty serving as its ideological and legal foundation. Today, representative democracy cannot be meaningfully discussed without considering the existence of political parties, as their role is far from insignificant. Therefore, the realization of democracy under the Constitution is closely tied to the successful practice of the party system. A complicating factor is that the reality of political parties falls short of the standards set by the related institutions, which are premised on their normative definition and requirements, and this discrepancy is by no means negligible. Consequently, the matter that is constantly discussed and must be carefully considered is the reform of political parties and the improvement of related legislation. These issues concerning political parties must be addressed with wisdom that seeks and implements development plans grounded in reality. This requires a comprehensive and multidimensional consideration for improvement, achieved by meticulously examining both the ideal model concerning the essence and functions of parties and the actual state of the operating system.

헌법은 국민주권주의를 이념적ㆍ법적 기초로 하여 민주주의를 기본 원 리로 하고 있고, 오늘날 대의민주주의는 정당의 존재를 배제하고는 그 운영의 실제를 논하기 어렵다고 할 정도로 정당의 비중이 작지 않다. 따 라서 헌법상 민주주의의 실현은 정당 제도의 성공적 실천과 밀접한 관련 을 맺고 있다고 할 것인데, 사정을 어렵게 만드는 요인은, 정당의 실상 이 그 규범적 정의와 요청을 전제로 구성되는 관련 제도의 규준에 걸맞 지 않은 면이 결코 무시할 수 있는 수준이 아니라는 점이고, 따라서 늘운위되고 있고 숙고되어야 하는 것이 정당의 개혁과 관련 법제의 개선에 관한 사안이라고 할 것이다. 이러한 정당에 관한 문제는 그 본질과 기능 에 관한 이상적 전범과 실제로 작동하고 있는 제도의 형편을 아울러 면 밀히 살핌으로써 현실적 토대에 발을 딛고 향상을 위한 종합적이고 입체 적인 고려를 담아낸 발전 방안을 모색, 이행하는 지혜로써 다루어져야 할 것이다.
