National security is an essential function of a state that seeks to protect its people and maintain safety from external aggression and threats, and the state, as long as, requires confidentiality held only by that state to ensure safety from the outside. However, in order to guarantee the people's right to know, a core value that maintains the system of a modern democratic state, the liberal state constitution declares the principle of disclosing information managed by state actions and state agencies to the public, but introduces national security and state secrets as an exception to this principle. There has been a consensus that the leakage of national secrets could pose a serious threat to national security even in the public's perception, but at the same time, they are striving to achieve the democratic goal of guaranteeing the people's right to know. As the 4th Industrial Revolution and the AI Revolution became a hot topic today, the protection of national secrets and the promotion of the public's right to know in national security policy are issues that can have a significant impact not only in the security sector but also in all areas including politics, economy, society and culture. In a modern democratic country where the importance of the people's right to know is emphasized and the system for requesting information disclosure is established, national confidential protection is facing a new era. There is a greater need than ever to find a balance between the protection of national confidentiality accompanying the implementation of national security policies and the promotion of the public's right to know.

국가의 안전보장은 외부의 직·간접적인 침략과 위협으로부터 자국의 국민을 보호하고 안전을 유지하고자 하는 국가의 필수 기능이며, 이때 국가는 외부로부터의 안전을 확보하기 위하여 그 국가만이 보유하는 기밀을 필요로 한다. 그런데 현대 민주주의 국가의 체제를 유지하는 핵심가치인 ‘국민의 알권리’ 보장을 위해 자유주의 국가 헌법은 국가행위와 국가기관에서 관리하는 정보를 국민에 대하여 공개하는 원칙을 천명하면서도, 이러한 원칙에 대한 예외로서 어김없이 도입하는 개념이 국가안보와 국가기밀이다. 국민 일반의 인식에도 국가비밀이 유출되면 국가안보에 심각한 위협이 될 수 있다는 공 감대가 형성되어 왔지만, 동시에 국민의 알권리 보장이라는 민주주의적 목적을 동시에 달성하기 위해 노력하고 있다. 4차 산업혁명·AI혁명이 화두가 된 오늘날, 국가안보정책상 국가 기밀 보호와 국민의 알권리 강화는 안보분야 뿐만 아니라 정치·경제·사회·문화 등 우리 사회 모든 영역에서 중대한 영향을 줄 수 있는 이슈이기 때문이다. 국민의 알권리의 중요성이 강조되고 정보공개청구제도가 정착되어 가는 현대 민주주의 국 가에서 국가기밀 보호는 새로운 시대적 상황에 직면해 있다. 국가안전보장 정책 집행에 수반 되는 국가기밀 보호와 국민의 알권리 증진간 균형을 모색할 필요가 그 어느 때 보다 커지고 있다.
