This study aims to examine the current status and structural causes of the rapidly increasing number of foreign drug offenders in South Korea and to propose prevention-oriented policy directions grounded in criminological theory. An analysis of official statistics from the Supreme Prosecutors’ Office of Korea (2025) shows that the number of foreign drug offenders increased nearly fivefold, from 640 in 2015 to 3,232 in 2024. Moreover, their involvement has diversified beyond simple drug use to include transportation, storage, and brokerage within drug distribution networks. These trends cannot be explained solely by the growth of the foreign resident population; rather, they appear to be associated with multiple structural factors, including unstable residence and employment conditions, language and cultural barriers, limited legal awareness, and links to international drug supply chains. Drawing on Routine Activity Theory (Cohen & Felson, 1979) and Cognitive Transformation Theory (Giordano et al., 2002), this study proposes a three-stage prevention framework: (1) restoring capable guardianship, (2) reducing target suitability, and (3) weakening offender motivation. The findings underscore the necessity of recovery-oriented policies that integrate prevention, treatment, and social reintegration, offering both theoretical and practical implications for addressing foreign drug offenders beyond a punishment-centered approach.

본 연구는 최근 한국 사회에서 증가하고 있는 외국인 마약류 사범의 현황과 구조적 원인을 문헌연구를 통해 분석하고, 범죄학 적 이론에 근거한 예방정책 방향을 모색하는 데 목적이 있다. 대 검찰청(2025)의 통계를 검토한 결과, 외국인 마약류사범은 2015 년 이후 지속적으로 증가하였으며, 범죄 유형 또한 단순 투약에 서운반ㆍ보관ㆍ중개 등으로 다변화되는 경향을 보였다. 이러한 현상은 불안정한 체류ㆍ고용 구조, 언어ㆍ문화적 장벽, 법 인식 부족, 국제 공급망과의 연계 등 구조적 요인과 관련되는 것으로 해석된다. 본 연구는 일상활동이론과 인지적 전환 이론을 적용하 여 범죄 기회 구조와 회복 가능성을 분석하고, 감시자 복원, 표 적 약화, 동기 억제를 중심으로 한 3단계 예방 프레임워크를 제 시하였다. 이는 외국인 마약류사범 문제에 대해 처벌 중심을 넘 어 예방과 회복을 연계한 통합적 접근의 필요성을 시사한다.
