As technology becomes increasingly advanced and converged, the importance of patents grows daily. However, many companies still fail to respond appropriately during patent disputes. This study empirically analyzed the response strategies companies prioritize during patent disputes, focusing on three advanced technology-based industries: electrical/electronics(34), mobility(16), and bio/medical(27). A Delphi survey and questionnaire were administered to patent practitioners and experts. The analysis revealed that in the electrical/electronics industry, the most important strategies were patent invalidation lawsuits, royalty payments, patent litigation, joint litigation, and cross-licensing. In the mobility industry, the order of importance was cross-licensing, patent invalidation lawsuits, joint litigation, royalty payments, and patent litigation. and in the bio/medical industry, the order of importance was patent litigation, royalty payments, joint litigation, cross-licensing, and patent invalidation lawsuits. These findings provide industry-specific comparisons and empirical data for research on patent dispute response strategies and can serve as practical guidelines for corporate IP practitioners developing response strategies during patent disputes. As this study focused on high-technology industries, its generalizability is limited. Future research should analyze and propose patent dispute response strategies across a broader range of industries.

기술이 첨단화되고 융복합화 될수록 특허의 중요성은 나날이 증가하고 있다. 그러나 아직까지 많은 기업들은 특허 분쟁 시에 적절한 대응을 하지 못하고 있는 실정이다. 이에 본 연구에서는 첨단기술기반 산업 중 전기전자(34개사), 모빌리 티(16개사), 바이오/의료(27개사) 산업을 대상으로 특허 분쟁 시 기업이 중요하게 고려하는 대응 전략을 실증적으로 분석하 였다. 특허 실무자 및 전문가를 대상으로 델파이 조사와 설문조사를 실시하였고 분석 결과, 전기전자 산업에서는 특허 무효화 소송, 로열티 지급, 특허 소송, 연대 소송, 크로스 라이선스, 모빌리티 산업에서는 크로스 라이선스, 특허 무효화 소송과 연대 소 송, 로열티 지급, 특허 소송, 바이오/의료 산업에서는 특허 소송, 로열티 지급, 연대 소송, 크로스 라이선스, 특허 무효화 소송 순 으로 중요도가 나타났다. 본 연구 결과는 특허 분쟁 대응 전략 연구에 산업별 비교와 실증자료를 제공하며, 기업의 IP 실무 자들이 특허 분쟁시 대응 전략을 수립하는데 실무적 지침으로 활용 가능할 것으로 보인다. 본 연구는 첨단기술기반 산업을 대상으로 연구를 수행하여 일반화에는 한계가 있기 때문에 향후 연구에서는 보다 다양한 산업을 대상으로 특허 분쟁 대응 전략을 분석하고 제시할 필요가 있다.
