As a response to the crisis and limitations of representative democracy, the Citizens’ Assembly has emerged as an alternative form of democratic innovation that secures democratic legitimacy in terms of representativeness, deliberativeness, and political equality. First, it ensures representativeness by reflecting society “as it really is,” avoiding both over-representation and under-representation of particular social groups. Second, it transcends partisan politics and vested interests produced by electoral competition, enabling participants to pursue the common good through deliberation. Third, it realizes political equality, since political decision-making power is not monopolized by elites or specific classes but is equally distributed among all citizens. To prevent the outcomes of a Citizens’ Assembly from becoming a “closed-door exercise” or a mere “storm in a teacup,” broad public deliberation and social dissemination are required to build a national consensus and translate its results into institutional reform. In the era of popular sovereignty, Citizens’ Assembly can serve as a genuine path toward realizing a democracy in which the people —and residents themselves—are truly the sovereign.

대의민주주의의 위기와 한계를 극복할 대안으로 등장한 시민의회(citizens’ assembly)는 대표성, 숙의성, 정치적 평등성 차원에서 민주적 정당성을 갖추고 있다. 첫째, 특정 사회계층의 과다 또는 과소 대표가 아니라 각계각층의 국민을 있는 그대로 반영해 대표성을 확보할 수 있다. 둘째, 선거로 인한 당파정치와 정치적 이해관계에서 벗어나 숙의를 통해 공공선(common good)을 추구할 수 있다. 셋째, 정치적 의사결정에 엘리트나 일부 계층이 아닌 모든 시민이 동등한 영향력을 행사할 수 있으므로 ‘정치적 평등’(political equality)을 구현할 수 있다. 시민의회의 논의 결과가 참여자들만 의 숙의로 끝나지 않기 위해서는 ‘사회적 공론화’를 통해 국민적 공감대를 형성해야 제도개혁으로 성공할 수 있다. 국민주권시대에 시민의회는 ‘국민이 주인인 나라’를 통해 진정한 민주주의를 구현하는 길이 될 수 있을 것이다.
