The rapid expansion of digital technologies and generative AI requires a fundamental rethinking of authorship and copyright. This paper poses the following central question: “In the age of AI, whose copyright is it?” It critically examines Nicolas Bourriaud’s notion of postproduction and analyzes pertinent key cases, including the Getty Images lawsuit, ChatGPT’s replication of Studio Ghibli’s visual style, and the legal conflict between the Writers Guild of America and OpenAI. Reinterpreting Walter Benjamin’s The Work of Art in the Age of Mechanical Reproduction, the study introduces the concept of the “Spectral Aura” to explain how the aura transforms under algorithmic reproduction. It further employs Rosi Braidotti’s posthuman ethics to propose a relational redefinition of creative subjectivity and copyright. Ultimately, the paper argues that creativity in the AI era must move away from the isolated originality of the singular author toward a distributed ethics of shared responsibility and multiple subjectivities.

디지털 기술과 생성형 인공지능의 확산은 창작과 저작권의 개념에 대한 근본적인 재고를 요청하고 있다. 본 연구는 “AI 시대, 저작권은 누구의 것인가?”라는 문제의식을 중심으로 ‘분산된 저작권(Distributed Copyright)’이라는 개념과 창작 주체의 해체, 그리고 그에 대한 윤리적·존재론적 재구성을 다층적으로 고찰한다. 이를 위해 부리오의 ‘포스트프로덕션’ 개념을 비판적으로 분석하고, 게티 이미지 소송, ChatGPT의 지브리 스튜디오 화풍복제 사건, 미국작가협회와 OpenAI의 법적 분쟁 등 생성형 AI 관련 저작권 사례를 분석함으로써, 창작의 책임과 권리를 어떻게 새롭게 배분할 수 있는지를 윤리적·제도적으로 탐색한다. 나아가 발터 벤야민의 󰡔기술복제 시대의 예술작품󰡕을 재해석함으로써, 그의 아우라 개념 이 알고리즘 기반 복제 환경 속에서 어떻게 변형되고 귀환하는지를 ‘유령적 아우라(Spectral Aura)’라는 이론적 틀을 통 해 정식화한다. 또한 로지 브라이도티의 포스트휴먼 윤리를 통해 창작 주체의 관계적 재정의를 제안한다. 본 논문은 AI 시대의 창작이 단일한 주체의 독점적 권리에서 벗어나, 관계적·분산적·공동체적 책임 구조로 나아가야 함을 주장한다.
