The private sector seeks to generate development profits through various planning changes within the urban planning system, while the public demands an appropriate return in the form of public benefits. As an alternative mechanism for recovering development profits, the pre-negotiation system is gaining attention, and an increasing number of local governments are adopting and implementing it. However, the system is introduced at the discretion of individual local governments, regardless of regional characteristics or administrative scale, resulting in inconsistencies in its operation—such as differences in the criteria for selecting negotiation sites and calculating public contribution rates. This study examines the institutional operation of the pre-negotiation system, focusing on basic local governments in Gyeonggi-do Province. It aims to identify problems arising in the process of introducing and managing the system and to propose standardized guidelines for its implementation. To achieve this, the study compares system operation cases across local governments in Gyeonggi-do with respect to site selection, public contribution ratios, implementation methods, and negotiation procedures. Institutional challenges and policy implications are derived through case study and simulation modeling.

사전협상제도를 도입하여 운영하고 있는 경기도내 지자체의 사전협상제가 명확한 기준을 설정하고 효율적으로 운영될 수 있도록 현재 운용되고 있는 사전협상제의 제도적 실태를 파악하고 문제점을 인식하여 개선방향을 제시하는데 목적이 있다. 이에 경기도 지자체를 대상으로 도시계획변경 사전협상제의 운용 실태를 파악하고자 하며, 이를 위해 현재 사전협상제를 운영하고 있는 경기도 지자체의 지침 및 기준, 관련 법령, 조례를 기준으로 한다. 연구방법은 사전협상제도를 운영하고 있는 11개 지자체의 제도 운용의 실태와 문제점을 파악하고자 사례 연구(case study)하였다. 각 지자체 홈페이지에서 고시·공고한 사전협상운영지침상 협상대상지 및 적용 기준, 공공기여 비율 기준, 공공기여 이행방식, 사전협상 절차 등 부분별로 구분하여 깊이 있게 분석하고자 자료를 구축하였으며 동일한 제도가 지자체별로 어떻게 운용되는지 분석하고자 수집된 자료를 비교분석 하였다. 또한, 도시계획 변경에 따른 개발이익 환수를 위한 제도의 운영 취지는 같으나 행정절차 및 제도운영 방식이 다른 제도별 차이를 분석하여 사전협상제도의 효과성과 문제점을 파악하고자 사전협상제도와 관련 유사제도를 비교 연구(comparative research) 하였다. 또 사전협상제도가 도입 및 운영의 초기단계이므로 실제로 사전협상을 완료한 개발사업 사례가 부족하기 때문에 도시계획 변경의 가상 시나리오를 설정하여 토지가치 상승의 시뮬레이션을 통해 분석하는 시나리오 분석(scenario analysis) 하였다. 용도지역 변경 및 상향에 따른 공공기여율과 지역별 토지가치 상승분의 차이를 통해 개발이익에 대한 환수율을 구하고, 결과 값을 바탕으로 제도의 개선 방향을 제시하고자 하였다. 경기도의 31개 시·군의 지역적 특성이 다양하므로 모든 기준을 통일하여 적용할 수는 없다. 다만, 본 연구를 통해 제도의 쟁점 사항과 이에 대한 적정한 기준안을 제시하고자 하였다.
