This study aimed to examine the EU Digital Services Act (DSA), which has been implemented in Europe, in order to establish a transparent and safe online environment. The research findings showed that intermediary service providers are classified into mere conduit, caching, and hosting services, and the scope of liability for each category has been clearly defined. In addition, the provisions on the “Good Samaritan” principle were formalized, while orders to act against illegal content and orders to provide information were introduced to impose accountability on service providers. Furthermore, the due diligence obligations for a transparent and safe online environment were divided into general obligations, obligations for hosting service providers, and obligations for online platforms, with differentiated rules applied to each category. Among these, the obligations concerning terms and conditions, annual transparency reporting, internal complaint-handling systems, and out-of-court dispute settlement were specified in detail to protect the rights of online service users. Based on these findings, three main implications were derived: first, strengthening the accountability of online service providers; second, protecting users’ rights; and third, adopting differentiated regulation. Drawing on these results, the study offers policy suggestions for building a trustworthy online environment.

이 연구는 투명하고 안전한 온라인 환경을 구축하기 위하여 유럽에서 적용되고 있는 EU 디지털서비스법에 대한 연구를 수행하고자 하였다. 연구 결과 중개서비스 제공자를 단순 전달, 캐싱 그리고 호스팅 사업자로 분류하고 있으며 각 사업자의 책임 범위를 구체화하고 있었다. 또한 선한 사마리아인 법에 대한 규정을 명문 화하고 있었으며 불법 콘텐츠에 대한 조치 명령과 정보제공 명령을 통해 사업자들의 책임을 규정하고 있었다. 그리고 투명하고 안전한 온라인 환경을 위한 주의의무를 공통의무, 호스팅 사업자 의무, 온라인 플랫폼 사업자의 의무 등으로 구분하고 각각을 차등적으로 규율하고 있 었다. 이중 이용약관과 연례보고 의무, 내부 불만 처리 시스템과 재판 외 분쟁 해결 의무를 상세히 규정하여 온라인 서비스 이용자의 권익을 보호하고자 하였다. 이를 바탕으로 온라인 서비스 제공자에 대한 책임성 강화, 둘째, 이용자 권익 보호 셋째, 차등 규제라는 시사점을 도출하였다. 이러한 연구결과에 근거하여 온라인 환경을 구축하기 위한 제언을 하였다.
