This study aims to conduct an in-depth review of the legal and institutional framework supporting corporate relocation policies as a key strategy to address the urgent issue of regional extinction and sustainable development in South Korea. Rapid population decline and the concentration of young populations in the metropolitan area have placed many local small and medium- sized cities at risk of disappearance, causing complex problems such as economic collapse, deterioration of public services, and declining quality of life for residents. Stable and quality job creation in local areas is essential to mitigate these issues, with corporate relocation emerging as a pivotal means. However, current legal systems are limited in effectively promoting corporate relocation due to dispersed authority between central and local governments, lack of inter-agency cooperation, discretionary operation of corporate incentives, and insufficient legal enforceability. This study analyzes these problems in detail, focusing on the lack of administrative coordination caused by authority fragmentation, uncertainty in incentive systems, and the legal ambiguity in unregulated competition among local governments. Furthermore, it proposes specific and practical legal and administrative reforms, including mandatory establishment of statutory corporate relocation plans, systematization and guaranteed application rights for tax incentives, introduction of public-private cooperation models linking local public institutions, and the legal institutionalization of corporate attraction contracts along with remedial procedures for contract breaches. These reforms are expected to enhance policy consistency, administrative trust, and predictability, thereby strengthening mutual confidence between local governments and corporations and significantly contributing to regional economic revitalization and the prevention of population extinction.

본 논문은 우리나라 지방 소멸 위기 상황에서 지역의 지속가능한 발 전과 인구 유출 방지를 위한 핵심 전략으로서 ‘기업의 지방 이전’ 정책 의 법적ㆍ제도적 기반을 심층적으로 검토하고자 한다. 급격한 인구감소 와 청년층의 수도권 집중화로 인해 지방 중소도시들이 소멸 위험에 처해있으며, 이는 지역 경제 붕괴와 공공서비스 기능 약화, 주민 삶의 질 저 하 등 복합적인 문제를 초래한다. 이러한 문제를 완화하기 위해서는 안 정적이고 양질의 지역 일자리 창출이 필수적이며, 기업의 지방 이전은 그 핵심 수단으로 부상하고 있다. 그러나 현행 법제도는 중앙정부와 지 방자치단체 간 권한 분산, 부처 간 협력 부족, 임의적인 기업 유치 인센 티브 운영, 법적 구속력 미흡 등으로 인해 지방 이전 정책의 실효성이 제한적이다. 본 논문은 이러한 문제점을 권한 분산에 따른 행정계획 연 계 부족, 인센티브 제도의 불확실성, 무분별한 지방 간 경쟁의 법적 무 규범성으로 세분하여 분석하였다. 나아가, 기업 이전 활성화를 위해 법 정 계획 수립 의무화, 세제 지원의 체계화 및 신청권 보장, 지역 공공기 관과 연계한 공공-민간 협력 모델 도입, 그리고 기업유치계약의 법적 제 도화와 이에 따른 계약 불이행에 대한 구제 절차 마련 등 구체적이고 실효적인 법적ㆍ행정적 개선방안을 제안하였다. 이러한 개선책은 정책의 일관성, 행정 신뢰성 및 예측 가능성을 제고함으로써 지방정부와 기업 간 상호 신뢰를 강화하고, 지방 경제 활성화 및 인구 소멸 위기 극복에 중요한 기여를 할 것으로 기대된다.
