This study examines the legislative issues surrounding casino industry regulation in Korea, with a particular focus on improving public perception of the industry. Under the current framework, casinos are permitted only as ancillary facilities within integrated resorts (IRs) pursuant to the Tourism Promotion Act, and are subject to multi-layered restrictions, including a ban on domestic patronage, strict location and facility requirements, complex licensing procedures, and heavy taxation such as the Tourism Promotion Fund levy, individual consumption tax, and proposed leisure tax. These constraints reinforce the market limitation of "foreigner-only" operations, diminish Korea’s attractiveness for foreign investment, and jeopardize the sector’s sustainability. This paper proposes: (1) reconsideration of the domestic entry ban policy; (2) rationalization of overlapping taxation systems; (3) a modern reinterpretation of the concept of gambling; (4) establishment of a specialized regulatory body (e.g., Gambling Regulatory Authority or Casino Commission) to oversee anti-addiction measures, anti-money laundering, and licensing; and (5) creation of a one-stop licensing system for IR projects. Furthermore, the study emphasizes the need for regulatory sandboxes and tailored regulatory frameworks to revitalize the IR sector. Such reforms can reposition the casino industry as a strategic tourism and cultural convergence industry rather than merely a gambling business.

본 연구는 국내 카지노업 관리 입법의 문제점을 분석하고, 특히 산업에 대한 부 정적 인식을 개선하는 방향에서의 제도개선 방안을 모색하였다. 우리나라 카지노 업은 ｢관광진흥법｣을 중심으로 복합리조트의 부대시설로만 허가되는 구조를 가지 며, 내국인 출입금지, 입지·시설요건 제한, 복잡한 인허가 절차, 과도한 과세 부담 등 다층적인 규제를 받고 있다. 이러한 규제는 외국인 전용이라는 시장 한계를 고 착화시키고, 글로벌 경쟁에서 투자 매력을 저하시켜 산업의 지속 가능성을 위협한 다. 본 연구는 ▲내국인 제한 정책의 재검토, ▲관광진흥기금·개별소비세·레저세 등 중복과세 구조의 합리화, ▲사행성 개념에 대한 시대적 재해석, ▲카지노업 전문 규제기구(도박규제청·카지노관리위원회) 설치, ▲복합리조트 원스톱 인허가 체계 구축을 제안하였다. 특히 사행산업감독위원회와 별도의 전문 관리기구를 통한 중 독방지, 자금세탁방지, 국제 경쟁력 제고의 필요성을 강조하였으며, 규제샌드박스· 맞춤형 규제 설계를 통해 복합리조트 산업 활성화를 도모할 것을 주장하였다. 이러 한 개선방안은 카지노업을 단순 사행산업이 아닌 관광·문화 융합형 전략산업으로 전환하는 데 기여할 수 있을 것이다.
