This study examines the possibility of introducing a “right to claim additional compensation” system in domestic legislation, which would allow creators of audiovisual works to demand additional compensation under certain conditions. To this end, the study analyzes Article 20 of the EU DSM Copyright Directive, relevant provisions and cases under French and German copyright laws, and reviews the principles of unfair legal acts and change of circumstances under Korean civil law. Additionally, various legal issues such as constitutional legitimacy, limitations on the principle of private autonomy, and consistency with the doctrine of transfer of property rights were analyzed from multiple perspectives. The results of the study suggest that the introduction of a system of additional compensation claims for audiovisual work creators is feasible in the domestic context under strict conditions. Particularly, it is important to calibrate the system so that it does not unduly infringe upon contractual freedom by setting “significant imbalance” between profits and compensation as a prerequisite for claims. This study proposes specific legislative proposals for amending existing laws, which can serve as a foundation for future discussions on the matter.

본 연구는 영상저작물 저작자에게 일정한 요건 하에 추가적인 보상 을 청구할 수 있도록 하는 “추가보상청구권” 제도의 국내 입법 가능성 을 검토한다. 이를 위해 EU DSM 저작권 지침 제20조, 프랑스 및 독일 저작권법상 관련 규정과 사례를 분석하고, 우리 민법상 불공정한 법률 행위와 사정변경의 원칙을 검토하였다. 또한 헌법적 정당성, 사적 자치 의 원칙 제한, 재산권 양도 법리와의 정합성 등 다양한 법적 쟁점을 다각도로 분석하였다. 연구 결과, 국내 현실에서는 엄격한 요건 하에 영상저작물 저작자에 한정된 추가보상청구권 제도의 도입이 가능하다고 보았다. 특히 수익 과 보상 간에 ‘현저한 불균형’이 있는 경우를 청구 요건으로 삼아 계약 의 자유를 과도하게 침해하지 않도록 조율하는 것이 중요하다. 본 연 구는 실정법 개정을 위한 구체적인 입법안을 제안함으로써 향후 관련 논의에 조금이나마 도움이 되고자 하였다.
