This paper examines the reasons why a trademark application may be refused registration, focusing in particular on Article 33(1)(vii) of the Trademark Act. Although Article 33(1)(vii) uses the phrase ‘trademarks other than those falling under subparagraphs (i) to (vi)’ with regard to the requirements for trademark registration, it has nonetheless been invoked alongside grounds under subparagraphs (iii), (iv), and (vi) to reject applications or in legal disputes. However, according to a textual interpretation, Article 33(1)(vii) is only applicable to trademarks other than those falling under subparagraphs (i) to (vi). Thus, this paper recommends using the simplified form, “other non-distinctive trademarks.” It is necessary to provide a more detailed interpretation and clarification of the legal nature of subparagraph (vii), as it is important to protect the legal rights of applicants and to ensure clarity for third parties who may not be related to the mark. Accordingly, this paper proposes simplifying the wording of subparagraph (vii) and establishing more concrete criteria for its application.

본 글에서는 출원상표가 등록되기 어려운 사유와 관련하여 상표법 제33조 제1항 각 호의 사유 중 제7호의 사유를 중심으로 검토하였다. 제7호는 상표등록의 요건과 관련하여 ‘제1호에서 제6호까지에 해당하 는 상표 외’라는 문구를 사용하고 있음에도 불구하고, 제3호 내지 제4 호, 제6호 등의 사유와 중복하여 출원시 거절되거나 판결에서 다투어 지고 있다. 그런데 문언해석에 의하면 제7호가 적용 가능한 부분은 어 디까지나 ‘제1호에서 제6호까지에 해당하는 상표 외’이므로 실무에 있 어 혼란이 있다. 이에 본 글에서는 해당 문구는 ‘기타 식별력이 없는 상표’와 같이 간소화할 것을 제안하였다. 출원인의 법적인 권리 보호가 필요하고, 아울러 해당 표장과 관련이 없는 제3자가 보더라도 명확함이 필요하기에 제7호의 해석과 법적 성 격에 대해서는 조금 더 구체적으로 제시되는 것이 바람직해 보인다. 이에 본 글에서는 제7호의 규정상 문구를 간소화하는 방안 및 제7호의 구체적인 기준을 좀 더 마련할 것을 방안으로 제시하였다.
